WHEREAS, an emergency has arisen in Special Item of Appropriation in the amount of Two Hundred Eighty-Seven Thousand, Seven Hundred Eighty-One Dollars and Zero Cents ($287,781.00), for the Edward Byrne Memorial Justice Grant Justice Assistance Grant (JAG) Program and no adequate provision has been made in the 2025 Temporary Budget for the aforesaid purpose; and
WHEREAS, N.J.S.A. 40A:4-20 provides for the creation of an emergency appropriation for the purpose above-mentioned; and
WHEREAS, pursuant to Resolution 7R9-e adopted on July 2, 2025, the City of Newark accepted funds from the United State Department of Justice, Bureau of Justice Assistance in the amount of Two Hundred Eighty-Seven Thousand, Seven Hundred Eighty-One Dollars and Zero Cents ($287,781.00) to fund overtime cost to address violent crime to be distributed among several municipalities within Essex County; and
WHEREAS, N.J.S.A. 40A:4-20 provides that the Governing Body by a two-thirds vote may make temporary emergency appropriations for any purpose for which appropriations may lawfully be made for the period between the beginning of the current fiscal year and the date of the adoption of the budget for said year; and
WHEREAS, pursuant to the Grant Award, a Memorandum of Understanding among the participating municipalities, represented by their respective law enforcement Executive, has allocated funding pursuant to the following schedule:
Newark Police Division = $197,417.00
Irvington Police Department = $37,753.00
East Orange Police Department = $39,414.00
Essex County Sheriff’s Office = $13,197.00; and
WHEREAS, emergency appropriation adopted in 2025 pursuant to N.J.S.A. 40A:4-20 including this Resolution total…………………$499,520,832.28.
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. The Governing Body by a two-thirds vote of its full membership hereby amends its temporary budget by making the following temporary emergency appropriation.
2. A temporary emergency appropriation be and the same is hereby made for the following classification.

3. Said emergency appropriation shall be provided for in the 2025 budget.
4. A copy of this Resolution shall be filed with the Director of Local Government Services by the City Clerk of the City of Newark.
STATEMENT
This Resolution establishes the temporary emergency appropriation for the JAG Program in the amount of Two Hundred Eighty-Seven Thousand, Seven Hundred Eighty-One Dollars and Zero Cents ($287,781.00). The United State Department of Justice, Office of Justice Programs, Bureau of Justice Assistance awarded the funds. The project period is October 1, 2023 through September 30, 2027.
