WHEREAS, on October 19, 2011, through Resolution 7R8-b, the Municipal Council of the City of Newark authorized the Mayor and/or the Acting Deputy Director of Newark One Stop Career Center-NewarkWORKS to accept the State of New Jersey Department of Labor and Workforce Development's annual grant allocation of $2,249,392.00 in Youth Workforce Investment Act Funds (see attached Notice of Obligation from State of New Jersey), pursuant to the Workforce Investment Act of 1998 ("WIA"); and
 
WHEREAS, there exists a need for Newark Stop One Career Center-NewarkWORKS (NOSCC) to enter into a contract with an entity that can provide employment, training, and supportive services to one-hundred (100) clients in the areas of academic enrichment and placement/retention ("Educational Training Services"), pursuant to the provisions of the WIA, for a period commencing on April 1, 2011 and terminating on June 30, 2012, with the WIA funds being fully expended by June 30, 2013; and
 
WHEREAS, on June 23, 2011 the NOSCC advertised a Request for Proposal for the above-referenced Educational Training Services under the provisions of the WIA for program year 2011-2012, which was returnable on July 8, 2011 (a copy of the Request for Proposal is attached hereto and made part thereof); and
 
      WHEREAS, on July 8, 2011, the NOSCC received seventeen (17) proposals in response to the above RFP, which were opened on July 8, 2011 and the proposal received from CHONJ/Newark Beth Israel Medical Center, 90 Parker Street, Newark, New Jersey, 07104, was found to be the most advantageous to the City of Newark based upon price, experience and all other criteria listed in the RFP; and
 
WHEREAS, NewarkWORKS wishes to enter into a fair and open contract with CHONJ/Newark Beth Israel Medical Center, to provide the above-referenced Educational Training Services to one-hundred (100) clients in an amount not to exceed $297,735.00 for program year 2011-2012 commencing on April 1, 2011 and terminating on June 30, 2012, with all funds being fully expended no later than June 30, 2013; and
 
      WHEREAS, this contract is being awarded pursuant to the WIA and is in compliance with New Jersey State Local Public Contracts Law (N.J.S.A. 40A:11-4.1(b)(2) and N.J.S.A. 40A:11-5(1)(q)), as the subject matter consists of educational services; and
 
      WHEREAS, this Educational Training Services contract is being awarded to a non-profit organization and as such is not governed by the State Pay-to-Play Law, N.J.S.A. 19:44A-20.5, or Newark Executive Order on Pay-to-Play Reform, MEO-07-0001.
 
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
 
1.      The Mayor and/or his designees, the Deputy Mayor/Director of Economic and Housing Development and Acting Deputy Director of Newark One Stop Career Center-NewarkWORKS are hereby authorized to enter into and execute a contract with CHONJ/Newark Beth Israel Medical Center, 90 Parker Street, Newark, New Jersey 07104, to provide employment, training, and supportive services to one-hundred (100) clients  in the areas of academic enrichment  and placement/retention ("Educational Training Services"), pursuant to the provisions of the WIA, for program year 2011-2012, for the period commencing on April 1, 2011, and terminating on June 30, 2012, with the WIA funds being fully expended by June 30, 2013, for an amount not to exceed $297,735.00.
 
2.      This Educational Training Services contract between the City of Newark and  CHONJ/Newark Beth Israel Medical Center is hereby ratified from April 1, 2011 to the date of adoption of this authorizing resolution.
 
3.      This Educational Training Services contract is subject to availability of funds from the U.S. Department of Labor, Employment and Training Administration, Workforce Investment Act of 1998 through the New Jersey Department of Labor and Workforce Development.
 
4.      Attached hereto is a certification of funds from the Municipal Comptroller of the City of Newark, which states (1) that there are sufficient funds, in the amount of $297,735.00 for purpose set forth herein above and (2) that the line appropriation of the official budget which shall be charged is Business Unit NW051, Department ID G11, Div/Proj. M1140, Activity A, Account, #72060, Budget Reference B2011.
 
5.      There shall be no advance payment on this contract in accordance with N.J.S.A. 40A:5-16.
 
6.      There shall be no amendment or changes to this contract without approval of the Municipal Council of the City of Newark.
 
7.      The Acting Deputy Director of Newark One Stop Career Center-NewarkWORKS shall file forthwith a copy of the fully executed copy of this Educational Training Services Contract in the Office of the City Clerk and shall be made available for public inspection.
 
8.      This contract is being awarded pursuant to the WIA and is in compliance with New Jersey State Local Public Contracts Law (N.J.S.A. 40A:11-4.1(b)(2) and N.J.S.A. 40A:11-5(1)(q)), as the subject matter consists of educational services.
 
9.      This Educational Training Services contract is being awarded to a non-profit organization and as such is not governed by the State Pay-to-Play Law, N.J.S.A. 19:44A-20.5, or Newark Executive Order on Pay-to-Play Reform, MEO-07-0001.
