WHEREAS, the National Insurance Crime Bureau, 435 Hamburg Turnpike, Wayne, New Jersey 07474, wishes to donate a 2013 Toyota Sienna, VIN# 5TDZK3DC0DS340114, valued at approximately Sixteen Thousand, Eight Hundred Fifty-Three Dollars and Zero Cents ($16,853.00) (a copy of an excerpt from the Kelley Blue Book relative to the vehicle’s value is attached hereto and made a part hereof); and
WHEREAS, on May 12, 2016, Sergeant Michael Santiago, Police Division, Public Safety Department, as designee of the Director of Public Safety, executed a Vehicle Donation Agreement with the National Insurance Crime Bureau (a copy of which is attached hereto and made a part hereof) which contains certain conditions relative to the acceptance of the gift, none of which the Director of Public Safety finds objectionable; and
WHEREAS, the Newark Public Safety Director recommends that the gift from the National Insurance Crime Bureau be accepted pursuant to N.J.S.A. 40A:5-29; and
WHEREAS, the gift shall not be put to any use which is inconsistent with the laws of New Jersey and of the United States; and
WHEREAS, the National Insurance Crime Bureau fully understands and acknowledges that it is not entitled to receive any direct or indirect benefit from the City of Newark in exchange for its gift, other than One Dollar ($1.00) as nominal consideration to formalize the Vehicle Donation Agreement.
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. The Mayor and/or his designees, the Business Administrator and/or the Public Safety Director, are hereby authorized to accept the gift from the National Insurance Crime Bureau, 435 Hamburg Turnpike, Wayne, New Jersey 07474, of a 2013 Toyota Sienna, VIN# 5TDZK3DC0DS340114, valued at approximately Sixteen Thousand, Eight Hundred Fifty-Three Dollars and Zero Cents ($16,853.00), and are further authorized to enter into and execute a Vehicle Donation Agreement with National Insurance Crime Bureau in relation thereto.
2. The Municipal Council ratifies the acceptance of the gift and the execution of the Vehicle Donation Agreement from May 12, 2016, to the date of the adoption of this authorizing resolution.
3. No municipal funds will be expended in the acceptance of this gift, other than the payment of One Dollar ($1.00) to the National Insurance Crime Bureau as nominal consideration to formalize the Vehicle Donation Agreement.
4. The original executed Vehicle Donation Agreement with the National Insurance Crime Bureau shall be filed in the Office of the City Clerk by the Public Safety Director.

This resolution authorizes and ratifies the actions taken by the Mayor and/or his designees, the Business Administrator and/or the Public Safety Director, to accept a gift from the National Insurance Crime Bureau, 435 Hamburg Turnpike, Wayne, New Jersey 07474, of a 2013 Toyota Sienna, VIN# 5TDZK3DC0DS340114, valued at approximately Sixteen Thousand, Eight Hundred Fifty-Three Dollars and Zero Cents ($16,853.00), and to enter into and execute a related Vehicle Donation Agreement with the National Insurance Crime Bureau.
