AN ORDINANCE AMENDING SECTION 23:3-5, NO TURN ON RED, OF TITLE 23, TRAFFIC AND PARKING, OF THE REVISED GENERAL ORDINANCES OF THE CITY OF NEWARK, NEW JERSEY, 2000, AS AMENDED AND SUPPLEMENTED, BY PROHIBITING RIGHT TURNS ON RED AT THE INTERSECTIONS OF WILSON AVENUE, FERRY STREET AND MERCHANT STREET.

WHEREAS, the Department of Engineering, Division of Traffic and Signals, desires to improve safety at the signalized intersections of Wilson Avenue, Ferry Street and Merchant Street, in the East Ward, by prohibiting right turn on red northbound and westbound.
NOW, THEREFORE, BE IT ORDAINED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
Section 1. That Section 23:3-5, No Turn on Red, of Title 23, Traffic and Parking, of the Revised General Ordinances of the City of Newark, New Jersey, 2000, as amended and supplemented, be amended by adding thereto the following:
No person shall turn a vehicle to make a right turn when facing a steady red signal (STOP) indication at the following locations, whenever an official sign is present prohibiting such a turn on the red signal:
Intersection Right Turn Prohibition
Wilson Avenue and Merchant Street West on Wilson Avenue to north on Merchant Street
Merchant Street and Wilson Avenue North on Merchant Street to east on Wilson Avenue
Section 2. Any existing ordinances or parts thereof inconsistent with this ordinance are hereby repealed.
Section 3. This ordinance shall take effect upon final passage and publication and in accordance with the laws of the State of New Jersey.
Section 4. This ordinance does not require approval by the Commissioner of Transportation.
STATEMENT:
This ordinance prohibits vehicles from making a right turn when facing a steady red signal indication at the intersections of Wilson Avenue, Ferry Street and Merchant Street in the East Ward, northbound and westbound, whenever an official sign is present prohibiting such a turn on the red.
