WHEREAS, the City of Newark, Department of Water and Sewer Utilities (the City and/or the Department), has determined the need for professional engineering services for the design and construction administration of the Ironbound Resilience HUB Project; and
WHEREAS, in accordance with N.J.S.A. 40A:11-4.1 et seq., a Request for Proposals (“RFP”) was publicly advertised and issued on May 28, 2025; and
WHEREAS, the City received three (3) proposals in response to the RFP by the submission deadline of June 18, 2025; and
WHEREAS, after evaluation, the proposal submitted by Michael Baker International, Inc., located at One Gateway Center, Suite 1601, Newark, New Jersey 07102, in an amount not to exceed $1,861,018.00, was determined to be in the best interest of the City; and
WHEREAS, Local Public Contracts Law N.J.S.A. 40A:11-5(1)(a) requires that notice of award of contracts for “Professional Services” without competitive bidding be published in a local newspaper; and
WHEREAS, this contract is for an amount over $17,500.00 and is being awarded as a fair and open contract pursuant to N.J.S.A. 19:44A-20.5 and is in compliance with State Pay-to-Play Statute.
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. The Mayor and/or his designee, the Director of the Department of Water and Sewer Utilities, are authorized to execute an agreement with Michael Baker International, Inc., One Gateway Center #1601 Newark, New Jersey 07102, to provide professional engineering services to the City of Newark, Department of Water and Sewer Utilities, for Design, and Construction Administration for the Ironbound Resilience HUB Project, in an amount not to exceed $1,861,018.00, commencing upon the issuance of a written Notice to Proceed and terminating upon project completion pursuant to N.J.S.A. 40A:11-15(9).
2. Pursuant to N.J.A.C. 5:30-5.5, attached hereto is a partial Certification of Funds issued by the Director of Finance which states that funds in the amount of $5,000.00 are available under Business Unit NW038 Department ID 800 Division 8003 Account 71280 Budget Year 2025. The certification shall be filed along with the original resolution in the Office of the City Clerk. The remainder of the funding for this contract will be
subject to appropriation in the 2025 Budget and funds will be certified prior to services being provided by the contractor.
3. A copy of the fully executed contract shall be filed in the Office of the City Clerk by the Director of the Department of Water and Sewer Utilities and shall be made available for public inspection.
4. A notice of this action shall be published in the newspaper authorized by law to publish a legal advertisement and as required by law within 10 days of its passage.
STATEMENT
This resolution authorizes the Mayor and/or his designee, the Director of the Department of Water and Sewer Utilities, to execute an agreement with Michael Baker International, Inc., One Gateway Center #1601 Newark, New Jersey 07102, to provide professional engineering services to the City of Newark, Department of Water and Sewer Utilities, for Design, and Construction Administration for the Ironbound Resilience HUB Project, in an amount not to exceed $1,861,018.00, until project completion pursuant to N.J.S.A. 40A:11-15(9).
