WHEREAS, the United States Department of Justice ("USDOJ") has made funds available through its Edward Byrne Memorial Discretionary Grants Program to assist, among other things, local jurisdictions with reducing the incidents of crime and enhance reentry services; and
 
WHEREAS, through Resolution 7R1-d, adopted June 18, 2008, the City of Newark Municipal Council ("Municipal Council") authorized the Mayor and/or his designee the Business Administrator to prepare a proposal and application to the USDOJ for a grant award in the amount of $424,815.00 for the Newark Returning Offender Initiative; and
 
WHEREAS, the USDOJ awarded the City of Newark ("City") a $424,815.00 grant for these services and has approved a budget that includes expenditures of $135,057.19 for Case Management and Job Placement Services for 54 individuals for the period of July 1, 2008 through December 31, 2010; and
 
WHEREAS, pursuant to Resolution 7R1-f 100108, the City accepted grant funds and entered into a grant agreement with  the USDOJ, for the grant award 2008-DD-BX-0630, in the amount of $424,815.00, for the Newark Prisoner Reentry Program, for the period commencing on July 1, 2008 and terminating on December 31, 2010; and
 
WHEREAS, the term for the above grant agreement was subsequently amended twice through Resolution 7R1-c 061710 and Resolution 7R1-i 092111, for the currently amended term of July 1, 2008 through September 30, 2012; and
 
WHEREAS, the City of Newark issued a Request for Proposals in July 2011, subject to the New Jersey Local Unit Pay-to-Play Law, N.J.S.A. 19:44A - 20.4, to obtain proposals from vendors to provide Case Management and Job Placement Services to formerly incarcerated individuals in accordance with the competitive contracting procedures of the Local Public Contracts Law, N.J.S.A. 40A:11-1 et seq.; and
 
WHEREAS, five vendors submitted proposals (the "Proposals") in response to the City's RFP; and
 
WHEREAS, the Proposals were reviewed and evaluated by staff from the Department of Economic and Housing Development, the Business Administrator's Office, and select community organizations (the "Review Committee"); and
 
WHEREAS, the Review Committee selected Offender Aid and Restoration of Essex County, Inc. ("OAR") located at 303 Washington Street, Newark, New Jersey, 07102, to serve forty-four (44) young adults with criminal records and the International Youth Organization ("IYO"), located at 703 South 12th Street, Newark, New Jersey, 07103, to serve ten (10) young adults with criminal records; and
 
WHEREAS, pursuant to Resolution 7R3-a(s) 012412, the Municipal Council authorized the Mayor and/or his designee, the Deputy Mayor/Director of the Department of Economic and Housing Development, to enter into and execute a Contract with OAR to provide Reentry Case Management and Job Placement Services (the "OAR Contract"), in an amount not to exceed $110,046.60, for the period of January 15, 2012 and terminating on September 30, 2012 (the "Original Contract Term"); and  
 
WHEREAS, OAR has already met its enrollment benchmark of 44 participants and has indicated to the City that it has additional capacity to serve more formerly incarcerated individuals; and
 
WHEREAS, the City, by letter dated January 4, 2012, notified IYO of its award, and negotiated the terms of the contract in good faith for several weeks, only for IYO to notify the City in late January that it would withdraw its bid, citing irreconcilable differences with the program model; and     
 
WHEREAS, the City, by letter dated March 26, 2012, requested that IYO confirm its bid withdrawal in writing, but IYO did not respond; and
 
WHEREAS, in light of IYO withdrawing its bid, the Department of Economic and Housing Development wishes to de-certify and reprogram IYO's award, in the amount of $25,010.59, and transfer said funds to OAR so that OAR may serve ten (10) additional participants in line with their initial proposal; and
 
WHEREAS, the Business Administrator requested a third extension of the expiration date for the grant agreement from September 30, 2012 to December 31, 2013, through the submission of a Grant Adjustment Notice to USDOJ, which was approved by USDOJ on July 17, 2012.
 
 
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
 
1.      The Business Administrator is hereby authorized to submit a Grant Adjustment Notice to the United States Department of Justice ("USDOJ") requesting an extension of the above grant period to July 1, 2008 through December 31, 2013 and the Municipal Council ratifies this action to the date of adoption of this resolution.
 
2.      The Mayor and/or his designee, the Deputy Mayor/Director of the Department of Economic and Housing Development, are hereby authorized to enter into and execute any necessary documents with the USDOJ effectuating the extension of the grant expiration date from September 30, 2012 to December 31, 2013. A copy of the USDOJ Grant Adjustment Notice approving the grant extension is attached hereto and made a part of this resolution.
 
3.      The Mayor and/or his designee, the Deputy Mayor/Director of the Department of Economic and Housing Development, are hereby authorized to enter into and execute a First Amended Contract, in the form attached hereto, with Offender Aid and Restoration, located at 303 Washington Street, Newark, New Jersey, 07102, which will increase the contract amount by $25,010.59, from $110,046.60 to $135,057.19, increase the number of participants served from 44 to 54, and extend the termination date of the Contract from September 30, 2012 to December 31, 2013.
 
4.      No Municipal funds are required.  
 
5.      Any funds which may have been certified to International Youth Organization shall be decertified.
 
6.      Attached hereto is a certification from the Municipal Comptroller as to the availability of funds in the amount of $25,010.59 for this First Amended Contract, which shall be drawn from the following line appropriation of the official municipal budget:

7.      This resolution and a fully executed copy of the First Amended Agreement shall be filed with the Office of the City Clerk by the Deputy Mayor/Director of the Department of Economic and Housing Development.
 
8.      All other terms and conditions contained in the Agreement authorized pursuant to Resolution 7R3-a(s) 012412 shall remain in full force and effect and in accordance with the law.
 
STATEMENT
 
This resolution ratifies and authorizes an amendment to the grant agreement between the City of Newark and USDOJ for the grant award number 2008-DD-BX-0630 in the amount of $424,815.00 to extend the grant expiration date from September 30, 2012 to December 31, 2013. Further, this resolution authorizes the Mayor and/or his designee, the Deputy Mayor/Director of the Department of Economic and Housing Development, to enter into and execute a First Amendment to Contract, in the form attached hereto, with Offender Aid and Restoration, located at 303 Washington Street, Newark, New Jersey, 07102, which will increase the contract amount by $25,010.59. from $110,046.60 to $135,057.19, increase the number of participants served from 44 to 54, and extend the termination date of the Contract from September 30, 2012 to December 31, 2013.
