WHEREAS, pursuant to Resolution 7R1-A, adopted on September 1, 2010, the Municipal Council of the City of Newark authorized the Mayor and the Business Administrator to enter into an agreement to receive and expend Community Development Block Grant (CDBG) funds from the United States Department of Housing and Urban Development (HUD) in the amount of $20,569,064.00; and
 
WHEREAS, due to the importance of the services and programs funded in whole or in part by CDBG funds awarded to the City of Newark and performed or operated by local sub-recipients for the benefit of the public, as well as the importance of utilizing HUD funding in a timely manner, the Mayor and Business Administrator believe it is in the best interest of the City of Newark and the public who benefit from the services and programs, to extend the contract agreement between Branch Brook Park Alliance, Inc. and the City of Newark an additional year; and
 
WHEREAS, pursuant to resolution 7R1-D, adopted September  8, 2011, the Mayor and/or his designee, the business administrator, were authorized to enter into an agreement with Branch Brook Park Alliance, Inc., 115 Clifton Avenue, Newark, New Jersey 07104 (hereinafter the "Sub-recipient"), awarding the sub-recipient a CDBG grant from CDBG funds in an amount not to exceed $150,000.00, to be used by the sub-recipient to provide Urban Agriculture/Tree Planting Services, for the period commencing on January 1, 2011, and terminating on December 31, 2011; and
 
WHEREAS, the Mayor and/or his designees, the Business Administrator desire to amend the terms of the existing agreement between the City of Newark and the Sub-recipient by extending the contract term through December 31, 2012, so that the Sub-recipient may provide further services of the same nature and type, and with no additional funding; and
 
WHEREAS, this agreement is being amended in compliance with Community Development Block Grant Regulations, 24 CFR.570.201.
 
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
 
1.      The Mayor and/or his designees, the Business Administrator are hereby authorized to enter into and execute an Amended Agreement on behalf of the City of Newark with  Branch Brook Park Alliance, Inc., 115 Clifton Avenue, Newark, New Jersey 07104, to provide further Urban Agriculture/Tree Planting Services, which is further described in the "Scope of Services" attached herewith as Exhibit A, for the amended agreement term of January 1, 2011, through December 31, 2012, with no additional funding.
2.      The Amended Agreement between the City of Newark and the Sub-recipient is hereby ratified from September 8, 2011 to the date of adoption of this resolution.
3.      This contract is being awarded pursuant to the Community Development Block Grant Regulations, 24 CFR.570.201 regulations, and is in compliance State Pay-to-Play Law, N.J.S.A. 19:44A-20.5 and Newark Executive Order ME0-02-0001, effective March 31, 2007.
4.      Attached hereto is a certification of funds from the Municipal Comptroller of the City of Newark which states that there are sufficient funds for the purposes hereinabove.
5.      As executed copy of said Amended Agreement shall be filed with the Office of the City Clerk by the Business Administrator.
6.      All other terms and conditions pursuant to Resolution 7R1-D, adopted September 8, 2011 remain in effect, and all other terms and conditions of the previously existing agreement shall also remain in full force and effect.
 
STATEMENT
 
This resolution ratifies and authorizes the Mayor and/or his designee, the Business Administrator to enter into an Amended Agreement with Branch Brook Park Alliance, Inc., 115 Clifton Avenue, Newark, New Jersey 07104, to provide further Urban Agriculture/Tree Planting Services for the amended agreement term of January 1, 2011, through December 31, 2012, with no additional funding.
