WHEREAS, on January 28, 2014, the City of Newark, through its Purchasing Director, advertised to solicit bids for contractor (s) to provide Lead Hazard Control and Reduction Services, for the Department of Health and Community Wellness; and

 

WHEREAS, the Division of Central Purchasing mailed twenty-three (23) packages to perspective vendors from its established bidders list following the date of advertisement; and

 

WHEREAS, on February 20, 2014, twelve (12) bids were received in response to this advertisement; and

 

WHEREAS, the bids received on February 20, 2014, were rejected by the Department of Child and Family Well-Being, now known as the Department of Health and Community Wellness, pursuant to N.J.S.A. 40A:11-13.2 (b). Revisions were made to the specifications and price schedules, but inadvertently omitted in the bid packages sent to the bidders; and

 

WHEREAS, on December 9, 2014, the City of Newark through its Purchasing Director, re-advertised to solicit bids for contractor(s) to provide Lead Hazard Control and Reduction Services, for the Department of Health and Community Wellness; and

 

WHEREAS, the Division of Central Purchasing mailed twenty-three (23) packages to prospective vendors from its established bidders list following the date of advertisement; and

 

WHEREAS, on January 8, 2015, ten (10) bids were received in response to this advertisement; and

 

WHEREAS, the Department of Health and Community Wellness, Division of Environmental Health and the Purchasing Division reviewed the responsive contractors and recommended the award be made in compliance with specifications section 7.0; and

 

WHEREAS, during the November 16, 2015 regular public meeting of the Newark Municipal Council resolution 7R1-a was adopted; and

 

WHEREAS, the Department of Health and Community Wellness failed to obtain the Housing and Urban Development Grant necessary to fund this contract. The Supervising Procurement Specialist/Purchasing Director is hereby requesting to rescind this contract award; and

 

WHEREAS, the Municipal Council wishes to rescind resolution 7R1-a adopted on November 16, 2015.

 

NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT: 

 

1. Resolution 7R1-a adopted November 16, 2015, is hereby rescinded in its entirety.

 

STATEMENT

 

This resolution rescinds resolution 7R1-a adopted November 16, 2015, contract awarded to A. Molly Company, Environmental Services, LLC, AS Environmental LLC, Apex Development, Inc., DYV Enterprises LLC, EnviroScience Solutions LLC, Joseph Environmental LLC, Lead Professionals, Inc. d/b/a AAA Lead Professionals, Optimum Environmental Solutions, Pro-Spec Painting, Inc. and Turningpoint Contracting Corp., to provide Lead Hazard Control and Reduction Services to the City of Newark, at a total cost not to exceed $2,000,000.00, for ten (10) vendors, for two (2) years.
