This Resolution authorizes a contract to operate the Newark Community Solutions which is  dedicated to the reform and improvement of the criminal justice system within the City of Newark for the Municipal Court.

 WHEREAS, on July 17, 2024, the City of Newark (“City”), through its Interim Purchasing Agent, advertised to solicit proposals for contractors to provide community service solutions for the Municipal Court, as described in the attached Request for Proposals (“RFP”) package; and     

 

 WHEREAS, the Division of Central Purchasing published the RFP on the City’s electronic procurement portal to provide broader access and download capability to potential bidders; and

            

WHEREAS, via the electronic procurement portal, forty-two (42) RFP packages were downloaded by prospective vendors following the date of advertisement; and

 

WHEREAS, on August 8, 2024, the Division of Central Purchasing received seven (7) proposals in response to this advertisement; and

 

WHEREAS, pursuant to the competitive contracting process, a three (3) member evaluation committee was formed to review the received proposals  and make a recommendation, as outlined in the specifications; and

 

WHEREAS, the Interim Purchasing Agent obtained signed no-conflict letters from the members of the evaluation committee (copies of which are attached hereto and made a part hereof) before releasing the RFP response to the evaluators via the electronic procurement portal; and

 

WHEREAS, the evaluation committee evaluated the seven (7) responses:1) Justice Innovation Inc. (520 8th Avenue, 18th FL, New York, New York 10018), 2) SCORES Re-entry (201 Monticello Avenue, Jersey City, New Jersey 07304), 3) HELPING WHERE I AM NEEDED (70 Mertz Avenue, Hillside, New Jersey 07205), 4) House of Elevation Coaching & Consulting LLC (777 Springdale Avenue, 6J, East Orange 07018), 5) Institute for Peace and Transformative Healing (638 Newark Avenue, Newark, New Jersey 07306), 6) Transform The Hustle (50 Halsey Street, Unit 444H, Newark, New Jersey 07102) and 7) Catherine Sackey (1465 Easton Avenue, Somerset, New Jersey, 08873); and

 

WHEREAS, the evaluation committee recommended that an award be made to Justice Innovation Inc. located at 520 8th Avenue, 18th FL, New York, New York 10018, based on their proposal being the most advantageous and in the best interest of the City  based on cost and other factors listed in the RFP; and

 

WHEREAS, the Interim Purchasing Agent concurred with the evaluation committee’s recommendation that a contract award be made to Justice Innovation Inc. located at 520 8th Avenue, 18th FL, New York, New York 10018 for an amount not to exceed Nine Hundred Ninety-Nine Thousand Eight Hundred Twenty-One Dollars and Zero Cents ($999,821.00), for the period of January 1, 2025 through December 31, 2025; and

 

WHEREAS, this contract is being awarded pursuant to the fair and open procedures of the State Pay-to-Play Law, N.J.S.A. 19:44A-20.5.

 

 

NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:

 

1.                     The Mayor and/or his designees, the Business Administrator, and/or the Qualified Purchasing Agent, are hereby authorized to enter into a contract with Justice Innovation Inc., 520 8th Avenue, 18th FL, New York, New York 10018, to provide community service solutions dedicated to reform and the improvement of the criminal justice system within the City of Newark (“City”) based on the evaluation committee finding Justice Innovation Inc. to be the most advantageous and in the best interest of the City pursuant to the criteria listed in the Request for Proposals (“RFP”), for a contract amount not to exceed Nine Hundred Ninety-Nine Thousand Eight Hundred Twenty One Dollars and Zero Cents ($999,821.00) for a period of January 1, 2025 through December 31, 2025.

 

2.                     There shall be no amendment or change of this contract without the approval of the Municipal Council by resolution.

 

3.                     Attached hereto is a partial Certification of Funds in the amount of Five Hundred Seventy-Five Six Hundred Nine Dollars and Sixty-Two Cents ($575,609.62) from the Municipal Comptroller of the City of Newark (“City”) and that the line appropriation which shall be charged is Business Unit NW011; Dept ID 200; Div./Proj. 2001; Account 97250; Budget Ref. B 2024.

 

4.                     This is an open-ended contract to be used as needed during the contract term. Thus, for any and all expenditures against this contract, a certification of the availability of sufficient funds, as required by N.J.A.C. 5:30-5.5(b)(2), shall be executed before a contractual liability is incurred each time an order is placed from Account Code Line: 2025 Budget/NW011-200-2001-97520-B2025/Municipal Court.

 

5.                     There shall be no advance payment on this contract in accordance with N.J.S.A. 40A:5-16. Funds for 2024 and subsequent years are contingent upon appropriations, pursuant to N.J.A.C. 5:30-5.5(d).

 

 

6.                     The Qualified Purchasing Agent shall file a duly executed copy of the contract in the Office of the City Clerk.

 

7.                     If required by State law, the City Clerk shall provide the appropriate notice of the award of this contract to the State Comptroller no later than twenty (20) business days following such award, in accordance with N.J.S.A. 52:15C-10 and the Notice of the Office of the State Comptroller dated May 7, 2008.

 

STATEMENT

 

This Resolution authorizes the Mayor and/or his designees, the Business Administrator and/or the Qualified Purchasing Agent, to enter into a contract with Justice Innovation Inc., 520 8th Avenue, 18th FL, New York, New York 10018, to operate the Newark Community Solutions Program at an amount not to exceed $999,821.00 for a period not to exceed twelve (12) consecutive months commencing upon Municipal Council approval of this Resolution.
