This Resolution ratifies and amends Resolution 7R3-b adopted on April 5, 2023 by extending the contract term from May 29, 2024 until construction completion.

WHEREAS, Resolution 7R3-b, adopted on April 5, 2023, authorized the Acting Director of the Department of Engineering to accept the proposal dated August 27, 2020, submitted by NV5, Inc., 800 Lanidex Plaza, Suite 300, Parsippany, New Jersey 07054, for Engineering Design Assistance services, Final Design (FD) services, and Construction Engineering Support (CE) services (the “Project”) for the proposed City of Newark Safe Routes to Schools Program, in the amount not to exceed Three Hundred Ninety-Six Thousand Nine Hundred Dollars and Sixty-Eight Cents ($396,900.68); and
WHEREAS, the original contract term was 365 days from the effective date of the issuance of the Notice to Proceed, or June 29, 2023 to May 29, 2024; and
WHEREAS, on January 20, 2025, NV5 Inc. requested a time extension to complete the preliminary design plans, detours and staging plans, a PE cost estimate, drainage evaluation and modifications plan, and significant Public Information Center efforts, therefore additional time is required to complete the Project for the proposed City of Newark Safe Routes to Schools Program; and
WHEREAS, the Acting Director of the Department of Engineering requests an extension of the contract term from May 29, 2024 until construction completion, as permitted by the Local Public Contracts Law, N.J.S.A. 40A:11-15(9); and
WHEREAS, the Acting Director of the Department of Engineering also requests the contract be ratified from May 29, 2024 to the date of adoption of this Resolution as NV5, Inc. continued work and providing services for the Project as it was necessary during that time for compliance with the project timeline.
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. The Mayor, and/or his designee, the Acting Director of the Department of Engineering, is hereby authorized on behalf of the City of Newark to issue Change Order No. 1 and execute a Contract Amendment to Contract No. 2021-05 PS, which will extend the contract term from May 29, 2024 until construction completion, with NV5, Inc., 800 Lanidex Plaza, Suite 300, Parsippany, New Jersey 07054, for Engineering Design Assistance services, Final Design (FD) services, and Construction Engineering Support (CE) services for the proposed City of Newark Safe Routes to Schools Program from May 29, 2024 until construction completion, with no additional cost to the City of Newark.
2. A fully executed copy of Change Order No. 1/Contract Amendment to Contract No. 2021-05 PS, shall be filed in the Office of the City Clerk by the Director of Engineering.
3. The Municipal Council hereby ratifies the contract term from May 29, 2024 to the date of adoption of this authorizing resolution.
4. No other changes to this contract are allowed without prior Municipal Council approval.
5. Any further extensions, as may be permitted by N.J.S.A. 40A:11-15(9), are subject to Municipal Council approval.
6.Notice of this Change Order for a professional services contract, in accordance with N.J.S.A. 40A:11-5(1)(a)(i), shall be published in the official newspaper of the municipality, which notice shall be filed in the Office of the City Clerk for inspection by the public.
STATEMENT
