WHEREAS, there are now pending before the Tax Court of New Jersey direct appeals challenging real property assessments in the Tax Court of New Jersey with regard to properties commonly and collectively known as St. Michael’s Medical Center for Tax Years 2016-2019, listed on the attached Schedule A, December 2019; and

 

WHEREAS, the City of Newark retained the law firm of DeCotiis, FitzPatrick, Cole & Giblin, LLP, to represent the interests of the City in these actions; and

 

WHEREAS, after review and analysis by the Tax Assessor for the City of Newark, appraisers of both the City and the taxpayer, and counsel, and after careful consideration, it is the opinion of the Tax Assessor, Corporation Counsel and Counsel that these settlements are in the best interests of the City of Newark; and

 

WHEREAS, the refund due as a result of the settlement shall be paid in the form of a credit against taxes due, and statutory interest, pursuant to N.J.S.A. 54:3-27.2, having been waived by the taxpayer, shall not be paid provided the credit is applied within sixty (60) days of judgment to any current and/or delinquent taxes, interest, or both, and shall remain on the account until such credit is exhausted.

 

NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:

 

1. The Corporation Counsel of the City of Newark and/or his designee, DeCotiis, FitzPatrick, Cole & Giblin, LLP, are hereby authorized to execute a Stipulation of Settlement with regard to certain properties as set forth in Schedule A, December 2019, after receipt of all documents deemed appropriate.

 

2. The City Clerk shall serve a copy of this resolution upon the Tax Assessor, Corporation Counsel, the Director of Finance and DeCotiis, FitzPatrick, Cole & Giblin, LLP.

 

 

STATEMENT

 

This resolution authorizes the Corporation Counsel and/or his designee to execute a Stipulation of Settlement with regard to Tax Appeals on properties set forth in Schedule A, December 2019.
