WHEREAS, Resolution 7R4-d adopted, August 7, 2013, authorized the Director of the Department of Engineering to execute Contract #07-2013 Renovations at the Detective Bureau, 21-45 Green Street (a.k.a. 22 Franklin Street), Newark, New Jersey 07102, with Bismark Construction Corporation, 207-209 Berkeley Avenue, Newark, New Jersey 07107, in the total bid amount of $677,000.00; and
WHEREAS, due to conditions discovered after the contract was awarded and interior demolition work had begun, the air conditioning units malfunctioned and had to be replaced. Minor changes in the scope of work is needed to address the conditions (See Attachment A); and
WHEREAS, the Director of the Department of Engineering has represented that these change orders are in compliance with N.J.A.C. 5:30-11.3 and 11.8, as they do not materially expand the size, nature of scope of the project, are due to unforeseen problems and conditions, and will effect cost savings; and
WHEREAS, the Director of the Department of Engineering desires to amend Contract #07-2013 to an increase of $22,421.25 in the total amount of the contract, thereby amending it from an amount not to exceed $677,000.00 to $699,421.25.
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. The Mayor and/or his designee and the Director of Engineering, are hereby authorized to execute Amendment #1 to Contract #07-2013, Renovations at the Detective Bureau, 21-45 Green Street (a.k.a. 22 Franklin Street), Newark, New Jersey 07102, with Bismark Construction Corporation, 207-209 Berkeley Avenue, Newark, New Jersey 07107,to amend the contract as follows: an increase of $22,421.25 in the total amount of the contract, thereby amending it from an amount not to exceed $677,000.00 to $699,421.25.
2. All other terms and conditions of Contract #07-2013 Renovations at the Detective Bureau, 21-45 Green Street (a.k.a. 22 Franklin Street), Newark, New Jersey 07102, shall apply and remain in force till the contract is completed.
3. A fully executed copy of Amendment #1 to Contract #07-2013 Renovations at the Detective Bureau, 21-45 Green Street (a.k.a. 22 Franklin Street), Newark, New Jersey 07102, shall be filed in the Office of the City Clerk by the Director of the Department of Engineering.
4. Funds for this contract in the amount of $699,421.25 shall be provided by the Essex County Improvement Authority ("ECIA") through the Bank of New York Mellon and payments made for this project shall be monitored by the City of Newark, Department of Finance.
5. No further amendments or modifications to this amended contract shall be permitted without prior Municipal Council approval.
6. A fully executed copy of this Change Order/Amendment shall be filed in the Office of the City Clerk by the Director of Engineering or his designee.

This resolution ratifies and authorizes the Mayor and/or his designee, the Director of Engineering, to execute Amendment #1 to Contract #07-2013 Renovations at the Detective Bureau, 21-45 Green Street (a.k.a. 22 Franklin Street), Newark, New Jersey 07102, with Bismark Construction Corporation, 207-209 Berkeley Avenue, Newark, New Jersey 07107, to an increase of $22,421.25 in the total amount of the contract, thereby amending it from an amount not to exceed $677,000.00 to $699,421.25.
