Additional Information:
Resolution 7R11-b(S) adopted on July 14, 2021 rescinded Resolution 7R11-b(S/A) adopted on June 22, 2022, due to an inadvertent failure to provide proper public notice as per State requirements for resolutions authorizing application and acceptance of State grant funds.
Additionally, Resolution 7R11-b(S) adopted on July 14, 2021, also authorized application/acceptance of grant funds to develop Broadway Park.
This amending Resolution will increase the grant funding by $5,660,000.00, supplementing underfunded portion of the project cost, previously estimated at $2,000,000.00, as per Resolution 7R11-b(S) adopted on July 14, 2021.
This amending Resolution will bring the total project cost to $7,360,000.00.

WHEREAS, the New Jersey Department of Environmental Protection, Green Acres Program (“State”), provides loans and/or grants to municipal and county governments and grants to non-profit organizations for assistance in the acquisition and development of lands for outdoor recreation and conservation purposes; and
WHEREAS, the City of Newark (the “City”) desires to further the public interest by developing a new City park by developing Broadway Park; and
WHEREAS, the Trust for Public Land (“TPL”), a non-profit organization dedicated to conserving land and developing parks for recreation and open space is partnered with the City to design and develop Broadway Park; and
WHEREAS, on July 14, 2021, the Municipal Council adopted Resolution 7R11-b(S), which authorized the Mayor of the City of Newark and/or his designee, the Director of the Department of Recreation, Cultural Affairs and Senior Services to apply for and accept grant funds in the amount of Two Million Dollars and Zero Cents ($2,000,000.00) from the State to fund the Broadway Park Project (#0714-21-UPG; 0714-21-011 Broadway Park); and
WHEREAS, pursuant to Resolution 7R11-b(S) adopted on July 14, 2021, the City accepted funds in the amount of One Thousand Two Hundred Dollars and Zero Cents ($1,200,000.00) from the Green Acres Program and Five Hundred Thousand Dollars and Zero Cents ($500,000.00) for the development of Broadway Park and the Mayor of the City of Newark and/or his designee are authorized to enter into and execute a grant agreement with the New Jersey Department of Environmental Protection, bringing the total amount of the grant to One Million Seven Hundred Thousand Dollars and Zero Cents ($1,700,000.00);
WHEREAS, the City desires to further the public interest by requesting an additional Green Acres loan and/or an additional Green Acres grant of Five Million Six Hundred Sixty Thousand Dollars and Zero Cents ($5,660,000.00) to fund the Broadway project(s); and
WHEREAS, the City desires to amend the previous apply and accept Resolution 7R11-b(S) of July 14, 2021 to increase the grant funding by Five Million, Six Hundred Sixty Thousands Dollars ($5,660,000.00), supplementing the underfunded portion of the project cost, previously estimated at Two Million Dollars, ($2,000,000.00) as per Resolution 7R11-b(S) adopted on July 14, 2021; and
WHEREAS, the City desires to amend the previous Green Acres Grant Agreement to increase the grant funding by Five Million Six Hundred Sixty Thousands Dollars and Zero Cents ($5,660,000.00), supplementing the underfunded portion of the project cost, previously estimated at Two Million Dollars and Zero Cents ($2,000,000.00) as per Resolution 7R11-b(S) adopte don July 14, 2021; and
WHEREAS, the State shall determine if the supplemental funding request is complete and in conformance with the scope and intent of the Green Acres Program, and notify the applicant of the amount of the funding award; and
WHEREAS, the applicant is willing to use the State’s funds in accordance with its rules, regulations and applicable statutes, and is willing to enter into an Amendment of the Agreement with the State for the Broadway Park Project (#0714-21-UPG; 0714-21-011 Broadway Park).
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. The Mayor of the City of Newark and/or his designee, the Director of the Department of Recreation, Cultural Affairs and Senior Services are hereby authorized to: (a) submit an application to the New Jersey Department of Environmental Protection, Green Acres Program requesting additional grant funding in the amount of Five Million, Six Hundred Sixty Thousands Dollars ($5,660,000.00), supplementing the underfunded portion of the project cost, previously estimated at Two Million Dollars and Zero Cents ($2,000,000.00) as per Resolution 7R11-b(S) adopted on July 14, 2021 to fund Project #0714-21-UPG; 0714-21011 Broadway Park; (b) provide additional information and furnish such documents as may be required to obtain additional grant funding for the Broadway Park Project; and (c) act as the authorized correspondent of the City.
2. The Municipal Council ratifies its authorization of this application from the date of the application submission to the date of the adoption of this authorizing Resolution.
3. The City of Newark agrees to provide the local government/non-profit share if a match is required.
4. The Municipal Council amends Resolution 7R11-b(S) adopte don July 14, 2021 and authorizes the Mayor of the City of Newark and/or his designee, the Business Administrator and/or the Director of the Department of Recreation, Cultural Affairs and Senior Services to enter into and execute an Amended Green Acres Agreement to fund Project #0714-21-UPG; 0714-21011 Broadway Park.
5. The City of Newark, Department of Recreation, Cultural Affairs and Senior Services agrees to comply with all applicable federal, state, and local laws, rules, and regulations in its performance of the project.
6. This Resolution shall take effect immediately.
STATEMENT
This resolution ratifies and authorizes the actions taken by the Director of the Department of Recreation, Cultural Affairs and Senior Services to submit an application for grant funding from the New Jersey Department of Environmental Protection, Green Acres Program to fund Project - #0714-21-UPG; 0714-21-011 Broadway Park located at between Broadway and Oraton Street, Newark, New Jersey 07104, Block 729 Lots 21, 24, 26, 75, 77, 79, 80, 81, 83, and 84, (the “Broadway Park Project”), and further ratifies and authorizes the Mayor of the City of Newark and/or the Director of the Department of Recreation, Cultural Affairs and Senior Services to enter into and execute an Amended Green Acres Project Agreement with and request grant funds in the amount of $5,660,000.00 from the State’s Green Acres Program to be used towards the Broadway Park Project for the grant period terminating two (2) years from the date the Amended Green Acres Project Agreement is executed by the State.
