WHEREAS, an assessment of The City of Newark Archive Building, 295 Halsey Street, Newark, New Jersey, conducted for the City of Newark Department of Engineering, revealed Archive building revealed the need for certain immediate repairs, especially, mold and mildew remediation.  The condition of the Archive Building has been creating extremely hazardous situations for City of Newark employees, due to the formation of significant mold infestation on the walls and floor of the basement level.  Mold in the workplace can pose a number of serious health problems.  This is a silent health threat which may lead to serious medical conditions, some deadly.  Everyone is potentially at risk for toxic mold exposure, regardless of geographic region, climate, socioeconomic status, race, age or gender; and,
 
      WHEREAS, the assessment exposed that severe and constant leakage from the roof and windows of the fourth floor also poses an imminent danger to the city records and files kept in the archive; and
 
WHEREAS, the assessment also revealed a significant indentation and a sagged area created on the back section of the third floor level.  Through the years, the structural components supporting that area have weakened.  As a result, an indentation has been formed on the third floor which imposes a serious hazard of structural failure of the deflected area.  This may lead to brittle failure of the beams and joists causing a sudden collapse.  
 
WHEREAS, the Department of Engineering, on November 19, 2013, declared an emergency regarding the repairs and after concurrence by the Inspector General and the Purchasing agent Emergency Contract E2013-19 dated November 25, 2013 in the not to exceed amount of $646,800.00 was awarded to Point-On Construction, 2037 Lemoine Avenue, Fort Lee, New Jersey 07062; and  
 
      WHEREAS, the process for obtaining permits commenced for the repairs but due to the cancelled repair project for the Archive building, the UCC Division required the old permits to be closed in order for the new permits to be obtained by Point-On Construction.  Therefore, the UCC Division issued a stop work on the project; and
 
WHEREAS,   It is imperative that the City of Newark continue the repair work to be done on the City Archive Building to eliminate the actual and imminent health and other hazardous; and,
 
WHEREAS, in accordance with the provisions of  N.J.A.C 5:34-6.1, the City needs to request an of an extension of the existing emergency contract  (E2013-19) to complete the repairs of the City Archive Building, eliminate the actual and imminent health and other hazards, at no additional cost to the City of Newark; and
 
WHEREAS, City Ordinance  2:5-13.2(E)(1) (b), (c), states that Emergency Contracts shall not be for a period in excess of ninety (90) days; and no extensions of an emergency contracts shall be permitted without authorization by Resolution by the Municipal Council.
 
      
      NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
 
1.      The Mayor and/or his designee, the Director of the Department of Engineering is hereby authorized to extend the existing emergency contract with Point-On Construction, 2037 Lemoine Avenue, Fort Lee, New Jersey 07024, for the repair of the City Archive building, 295 Halsey Street, Newark, New Jersey 07102.   
 
2.      This extension will allow the continuation of Emergency Contract E2013-19 which commenced on November 25, 2013 through February 24, 2014, or until the actual and imminent emergency condition is abated , at no additional cost to the City of Newark.
 
3.      Attached hereto is a budget detail document which shows that there are sufficient funds for the purpose set forth hereinabove in the Engineering Budget

4.      An executed copy of said emergency contract extension shall be filed with the Office of the City Clerk by the Business Administrator for the City of Newark.
 
5.      The total amount of said emergency including the amount expended to date shall not exceed $646,800.00.
 
 
STATEMENT
 
This resolution authorizes the Mayor and/or his designees, the Director of the Department of Engineering to extend Emergency Contract E2013-19 with Point-On Construction, 2037 Lemoine Avenue, Fort Lee, New Jersey 07062, for the repair of the City of Newark  Archive Building 295 Halsey Street for the period from February 24, 2014 until August 24, 2014 or until such earlier time as the emergency condition is abated for accost not to exceed $646,800.
