WHEREAS, the State of New Jersey Department of Transportation (NJDOT) FY 2023 Bikeways State Aid Program provides municipalities with grant funding for bicycle lane projects; and
WHEREAS, on July 1, 2022, the Director of the Department of Engineering, on behalf of the City of Newark (“City”) applied to NJDOT requesting grant funding from the Bikeway State Aid Program for the Newark Downtown Connector, identified as application BIKE-2023 Newark Downtown Connector for City of Newark (“Project”); and
WHEREAS, on August 3, 2022, the Municipal Council adopted Resolution 7R3-a authorizing the Director of the Department of Engineering to apply for, accept, and enter into grant documents for a grant award for the Newark Downtown Connector; and
WHEREAS, on December 12, 2022, NJDOT announced that the City was selected to receive a grant award in the amount of Three Hundred Seventy-Nine Thousand Dollars and Zero Cents ($379,000.00) for the construction of the Project; and
WHEREAS, NJDOT requires the City to award the contract for construction of the Project within two (2) years of the announcement of the grant award, the initial deadline being December 11, 2024; and
WHEREAS, on September 05, 2024, the Municipal Council adopted a Resolution 7R3-b the Department of Engineering request for additional time to award the contract for construction of the Project, which extended the deadline from December 11, 2024 to June 12, 2025; and
WHEREAS, on June 04, 2025, the Municipal Council adopted a Resolution 7R3-b the Department of Engineering to request a second extension of time to award the contract for construction the Project, which extended the deadline from June 12, 2025 to December 12, 2025; and
WHEREAS, an additional extension is still required due to delay caused by the continued utility infrastructure coordination; and
WHEREAS, the City desires to request additional time to award a contract, which would extend the deadline to award a contract from December 11, 2025 to June 11, 2026.
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. The Mayor of the City of Newark and/or his designee, the Director of the Department of Engineering, are hereby authorized to request an extension from the New Jersey Department of Transportation to allow the City of Newark additional time to award a contract for construction of the Bikeway State Aid Program for the Newark Downtown Connector, from December 12, 2025 to June 11, 2026.
2. The Municipal Council hereby ratifies its authorization of this extension request back to December 11, 2025.
3. All other terms and conditions of the grant award from the NJDOT for Bikeway State Aid Program for Newark Downtown Connector project shall remain in force and effect until the contract is completed.
STATEMENT
This Resolution ratifies and authorizes the Mayor of the City of Newark and/or his designee, the Director of the Department of Engineering to request an extension from NJDOT to allow the City of Newark additional time to award a contract for construction of the Bikeway State Aid Program for Newark Downtown Connector. The request seeks to extend the deadline to June 11, 2026. No municipal funds are required.
