 WHEREAS, the City’s Department of Health and Community Wellness provides medical care services pursuant to and consistent with Health Care Program Statutes (Section 330 of Public Health Services Act: 42 U.S.C. Section 254(b), Program Regulation (43 CFR part 51 and 42 CFR 56.201) for Community and Migrant Health Centers and Grant Regulations (42 CFR part 74), Affordable Health Care Act; and

 

WHEREAS, the New Jersey Department of Health, Division of HIV, STD and TB Services has made grant funds available for the provision of such services; and

 

                     WHEREAS, on or about August 11, 2021, on behalf of the City of Newark (the “City”), the Director of the Department of Health and Community Wellness electronically filed an application to the New Jersey Department of Health, Division of HIV, STD, and TB Services, P.O. Box 363, Trenton, New Jersey 08625-0363, requesting grant funding for the continued provision of health care services to the medically underserved populated areas, which includes the City of Newark (a copy of the application is attached hereto and made a part hereof); and

 

WHEREAS, as a result of this application, the City was awarded a grant in the amount of $418,110.00 from the New Jersey Department of Health, Division of HIV, STD, and TB Services for the continued provision of health care services to the medically underserved populated areas, which includes the City of Newark for the period of September 1, 2021, through July 31, 2022, which was applied for and Temporary Emergency Appropriation resolutions were adopted 7R5-a 01/05/2022 File ID 21-1346  7R1-c 02/02/2022  File ID 22-0021, respectively (a copy of both resolutions are attached hereto and made a part hereof); and

 

WHEREAS, New Jersey Department of Health, Division of HIV, STD and TB Services for the continued provision of health care services to the medically underserved populated areas has awarded additional funds in the amount of Two Hundred and Fifty-Thousand and Nineteen Dollars and Zero Cents ($250,019.00), for the period September 1, 2021, through July 31, 2022, for a total amount of $668,129.00, (a copy of the Notice of Award is attached hereto and made a part hereof); and

 

WHEREAS, the Director of the Department of Health and Community Wellness did subsequently, on behalf of the City of Newark, cause the appropriate electronic submission to be made necessary to accept the grant mentioned above award; and

 

WHEREAS, the City recognizes that the New Jersey Department of Health, Division of HIV, STD, and TB Services may extend the time of the grant award and/or provide additional funds if made available; and

 

WHEREAS, the New Jersey Department of Health, Division of HIV, STD, and TB Services may amend the grant to reflect the grant time extension and/or increase or decrease of additional funds if made available; and

 

WHEREAS, the City’s Department of Health and Community Wellness shall, upon any such extension of time of the grant and or increase or decrease of additional funds, file an amending resolution reflecting the final term and award amount of the grant; and 

 

WHEREAS, the terms of this grant award may only be waived or amended by the parties duly authorized to execute the grant, subject to the approval of the Municipal Council by resolution.

 

NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:

 

1.                     The Mayor of the City of Newark and/or his designee, the Director of the Department of Health and Community Wellness, is hereby authorized to submit an application to the New Jersey Department of Health, Division of HIV, STD, and TB Services, Hubert H. Humphrey Building, P.O. Box 360, Trenton, New Jersey 08625-0360, requesting funding for the continued provision of health care services to the medically underserved populated areas, which includes the City of Newark.

 

2.                     The Municipal Council hereby ratifies its authorization of this application from the date of application submission to the date of adoption of this authorizing Resolution.

 

3.                     The additional grant award of Two Hundred Fifty Thousand and Nineteen Dollars and Zero Cents ($250,019.00), from the New Jersey Department of Health, Division of HIV, STD and TB Services is hereby accepted.

 

4.                     The Mayor of the City of Newark and/or his designee, the Director of the Department of Health and Community Wellness, are hereby authorized to receive and expend the additional grant award for the continued provision of health care services to the medically underserved populated areas, which includes the City of Newark for the period commencing on September 1, 2021, and terminating on July 31, 2022.

 

5.                     The City’s Department of Health and Community Wellness shall, upon any extension of time of the grant and/or increase or decrease of additional funds, file an amending resolution reflecting the final time and award amount of the grant.

 

6.                     The Municipal Council hereby ratifies the acceptance of this grant award from the date of the electronic acceptance on October 28, 2021, was filed to the date of adoption of this authorizing Resolution.

 

7.                     No municipal matching funds are required for the receipt or acceptance of this grant award.

 

8.                     The Director of the Department of Health and Community Wellness shall file a fully executed copy of the grant application and the grant award letter in the Office of the City Clerk.

 

                           

STATEMENT

 

This Resolution ratifies and authorizes the actions taken by the Mayor of the City of Newark and/or his designee, the Director of Health and Community Wellness, to apply for and accept additional grant funds in the amount of Two Hundred Fifty-Thousand and Nineteen Dollars and Zero Cents ($250,019.00), from the New Jersey Department of Health, Division of HIV, STD, and TB Services, for the period September 1, 2021, through July 31, 2022. The acceptance is ratified back to October 28, 2021.  No municipal matching funds are required for the receipt or acceptance of the grant funds.
