        WHEREAS, the City of Newark wishes to enter into a Federal Aid Agreement No. 2012-DT-BLA-205, with the New Jersey Department of Transportation, Division of Local Aid and Economic Development for reimbursement of costs for the Wilson Avenue Intersection Improvements (3 Locations - 2011); and
 
      WHEREAS, as part of Federal Aid Agreement No. 2012-DT-BLA-205, all allowable costs incurred for the performance of work in the Project Scope of Work and Cost Estimate (attached thereto) shall be eligible for reimbursement, from the effective date of the Basic Agreement, of September 13, 2011, with all such work to be completed by September 13, 2014, unless either terminated or extended, for the Wilson Avenue Intersection Improvements (3 Locations - 2011), City of Newark, Essex County, STP-7623(101) CON; and
 
      WHEREAS, the Municipal Council of the City of Newark hereby authorizes the Mayor and/or his designee, the Director of the Department of Engineering, to act as the authorized person to execute the Federal Aid Agreement No.  2012-DT-BLA-205 to accept the grant funds provided in the amount of $500,000.00 for the Wilson Avenue Intersection Improvements (3 Locations - 2011), City of Newark, Essex County, STP-7623(101) CON, in accordance with the Basic Agreement, dated September 13, 2011.
 
 
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
    1. The Mayor and/or his designee, the Director of the Department of Engineering, are hereby authorized on behalf of the City of Newark to execute the Federal Aid Agreement No. 2012-DT-BLA-205 to accept funds provided in the amount of $500,000.00 for the Wilson Avenue Intersection Improvements (3 Locations - 2011), City of Newark, Essex County, STP-7623(101)CON, in accordance with the Basis Agreement between the City of Newark and New Jersey Department of Transportation.
    3. The Mayor and/or his designee, the Director of the Department of Engineering, are hereby authorized on behalf of the City of Newark to solicit proposals/receive bids in accordance with the Local Public Contracts Law, N.J.S.A. 40A;11-1 et seq., in order to accomplish the objectives outlined in the Federal Aid Agreement No. 2012-DT-BLA-205 for the Wilson Avenue Intersection Improvements (3 Locations - 2011), City of Newark, Essex County, STP-7623(101)CON.
    1. No work shall commence prior to the receipt and budget insertion of the grant funds from the New Jersey Department of Transportation.
    3. The Director of Engineering shall file a fully-executed copy of the Federal Aid Agreement/Cost Reimbursement Agreement No. 2012-DT-BLA-205 in the Office of the City Clerk.
    1. No municipal funds are required for receipt or acceptance of this grant award.
    2. A fully executed copy of the Federal Aid Agreement shall be filed in the Office of the City Clerk by the Director of the Department of Engineering.
 
 
STATEMENT
 
This resolution ratifies and authorizes the Mayor and his/her designee, the Director of the Department of Engineering, to execute the attached Federal Aid Agreement No. 2012-DT-BLA-205 for the Wilson Avenue Intersection Improvements (3 Locations - 2011), City of Newark, Essex County, STP-7623(101)CON with the New Jersey Department of Transportation to accept grant funds in the amount of $500,000.00 for the period of September 13, 2011 through September 13, 2014.
