WHEREAS, by Resolution 7R11-b adopted on November 2, 2016, the Newark Municipal Council authorized the upgrade and maintenance of the City Emergency Operations Center’s video-wall controller to ensure interconnectivity between the City’s EOC, the City’s Mobile EOC, and State and federal agencies; and
WHEREAS, the above being a multiphase project, phase 1 having been completed and the Director of the Department of Public Safety and the Coordinator of the Office of Emergency Management Division, are desirous of commencing Phase 2 to upgrade and maintain the video-wall controller to ensure interconnectivity between the City’s Emergency Operations Center (EOC), the City’s Mobile EOC, and State and Federal agencies which includes IP-Remote Transmitter and Receiver, 19” chassis, VSS2 Desk rack, Control system and Software Licenses, WDP Control System, 3.5” Touchscreen Panel, 48 Port switching, MK06 Keyboard, Configuration and setup, Integration to existing WEY system, (described as Installed hardware phase 1b in the System Maintenance and Service Level Agreement) with 3 year maintenance agreement on all hardware, year 2 and year 3 contingent up the City’s receipt of additional funding; and
WHEREAS, the State 2004 Appropriations Act, P.L. 2004, c. 71, and as described by the Division of Local Government Services in Local Finance Notices 2004-21 and further reiterated as option No. 4 in Local Finance Notice 2009-20, allows local units to purchase goods from certain federal government contracts without the requirement for public bidding pursuant to the Local Public Contracts Law, and through this Resolution and properly executed contracts, the City of Newark plans to use such contracts to undertake the service, starting Phase 2 of upgrading and maintaining video-wall controller to ensure interconnectivity between the City’s Emergency Operations Center (EOC), the City’s Mobile EOC, and State and Federal agencies Which includes IP-Remote Transmitter and Receiver, 19” chassis, VSS2 Desk rack, Control system and Software Licenses, WDP Control System, 3.5” Touchscreen Panel, 48 Port switching, MK06 Keyboard, Configuration and setup, Integration to existing WEY system, and one (1) year maintenance with year two (2) and year three (3) maintenance subject to additional funding granted to the City; and
WHEREAS, the Coordinator of the City’s Office of Emergency Management Division and Homeland Security concludes that bidding is not practicable in order to meet acquisition timing; and
WHEREAS, the desired items are not available through a State contract or other in-State procurement process; and
WHEREAS, N.J.S.A. 52:34-10.6 authorizes the City to purchase equipment paid for or reimbursed by federal funds awarded by the United States Department of Homeland Security without public bidding if the contractor either (1) is a holder of a current State contract for the equipment, or (2) is participating in a federal procurement program established by a federal department or agency, or (3) has been approved by the State Treasurer in consultation with the New Jersey Domestic Security Preparedness Task Force; and
WHEREAS, WEY Technology, Inc., 21 West 39th Street, 6th Floor, New York 10018, was awarded Government Services Administration Contract Number GS-35F-130DA for “General Purpose Commercial Information Technology Equipment, Software and Services” (a copy of said GSA contract is attached); and
WHEREAS, WEY Technology, Inc. has presented a proposal to the City of Newark, Office of Emergency Management and Homeland Security, whereby WEY Technology Inc. will start Phase 2 of upgrading and maintaining video-wall controller to ensure interconnectivity between the City’s Emergency Operations Center (EOC), the City’s Mobile EOC, and State and Federal agencies which includes IP-Remote Transmitter and Receiver, 19” chassis, VSS2 Desk rack, Control system and Software Licenses, WDP Control System, 3.5” Touchscreen Panel, 48 Port switching, MK06 Keyboard, Configuration and setup, Integration to existing WEY system, with 3 year maintenance agreement on all hardware and the services, year 2 and year 3 being subject to appropriated and available funding; and
WHEREAS, the total amount not to exceed $335,137.71 covers the Installed hardware phase 1b and year one (1) maintenance, year two (2) and year three (3) are at a cost not to exceed $59,096.69 each year and are contingent upon the City receiving additional grant funding; and
WHEREAS, WEY Technology, Inc. has represented that it is qualified by its experience and reputation for reliability and longevity to provide the upgrade and maintenance of the City EOC’s video-wall controller in a manner that is consistent with the terms and conditions set forth in the GSA contract; and
WHEREAS, the City of Newark, Office of Emergency Management and Homeland Security, desires to utilize GSA Contract Number GS-35F-130DA with WEY Technology Inc., 21 West 39th Street, 6th Floor, New York, New York 10018, to upgrade and maintain the City EOC’s video-wall controller at a cost not to exceed $335,137.71.
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. The Mayor and or his designee, the Director of Public Safety, and/ or the Coordinator of the Department of Public Safety, Office of Emergency Management and Homeland Security Division, are authorized to utilize GSA Contract Number GS-35F-130DA with WEY Technology, Inc., 21 West 39th Street, 6th Floor, New York, New York 10018, to start Phase 2 of upgrading and maintaining video-wall controller to ensure interconnectivity between the City’s Emergency Operations Center (EOC), the City’s Mobile EOC, and State and Federal agencies which includes IP-Remote Transmitter and Receiver, 19” chassis, VSS2 Desk rack, Control system and Software Licenses, WDP Control System, 3.5” Touchscreen Panel, 48 Port switching, MK06 Keyboard, Configuration and setup, Integration to existing WEY system, also described as installed hardware phase 1b and year one (1) maintenance on all hardware, at a cost not to exceed $335,137.71. Year two (2) and Year (3) Maintenance in the amount of $59,096.69 for each year is subject to receipt by the City of available and appropriated additional funding.
2. The term of this contract for installation of phase 1b and year 1 maintenance shall be January 30, 2018 through March 31, 2019. Year two maintenance shall commence April 1, 2019 and terminate March 31, 2020 and Year three maintenance April 1, 2020 to March 31, 2021 subject to additional appropriate funding.
3. No municipal funds shall be required, as the project is fully funded through New Jersey Office of Homeland Security and Preparedness grant funds, as a pass-through of federal preparedness assistance funds awarded by the United States Department of Homeland Security.
4. There shall be no advance payment on this contract in accordance with N.J.S.A. 40A:5-16.
5. There shall be no amendment of this contract without the approval of the Newark Municipal Council by resolution.
6. Attached are Certification of Funds issued by the Director of Finance of the City of Newark which states that there are available sufficient legally appropriated funds for the purposes set forth herein above.
7. The Coordinator of the Office of Emergency Management and Homeland Security shall file a duly executed copy of the contract in the Office of the City Clerk.
STATEMENT
This Resolution authorizes the Mayor and/or his designee, the Director of the Department of Public Safety and/ or the Coordinator of the Department of Public Safety, Office of Emergency Management and Homeland Security Division, to utilize GSA Contract Number GS-35F-130DA with WEY Technology, Inc., 21 West 39th Street 6th Floor, New York, New York 10018, to commence Phase 2 of the upgrade and maintenance of the City Emergency Operations Center’s video-wall controller at a cost not to exceed $335,137.71 with year two and year three maintenance being subject to appropriation and availability of additional funding.
