WHEREAS, on February 10, 2015, the City of Newark, through its Director of Purchasing, advertised to solicit bids for contractors to provide 2014 or Newer Chevrolet Tahoe 4 WD, 4 Door LTZ to the Newark Police Department through the Division of Motors, as per the proposal attached hereto; and
WHEREAS, the Division of Central Purchasing distributed eleven (11) bid proposal packages to prospective vendors following the date of advertisement; and
WHEREAS, on February 26, 2015, four (4) bids were received in response to this advertisement; and
WHEREAS, the Manager of Motors and the Police Director reviewed the bids and recommended that an award be made to the lowest responsive responsible bidder, Day Chevrolet; and
WHEREAS, pursuant to N.J.S.A. 40A:11-24 the vendor agreed to hold its prices for 90 days from the bid receipt date; and
WHEREAS, pursuant to N.J.S.A.19:44A-20.5 et seq., solicitations through public bidding in accordance with N.J.S.A.40A:11-1 et seq. meets the requirements of the fair and open process.
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. The Mayor and/ or his designee, the Purchasing Director, are hereby authorized to enter into a contract with Day Chevrolet 1600 Golden Mile Highway, Monroeville, Pennsylvania 15146, to provide (5) five 2014 or Newer Chevrolet Tahoe, 4 WD, 4 Door LTZ to the City of Newark, whose bid was received on the advertised due date and determined to be the lowest responsive responsible bidder in accordance with specifications. Upon adoption of the resolution by the Municipal Council the term of the contract will be established, upon complete delivery not to exceed December 31, 2015.
2. There shall be no amendment or change of this contract without the approval of the Newark Municipal Council.
3. Funds for this acquisition are encumbered on PO# 1703 Fund NW026 Account 46120 Budget Year B2014 for the total of $250,300.00. This contract shall not exceed $250,300.00.
4. It is the responsibility of the Director of the Department of Engineering, Division of Motors to ascertain that the (5) five 2014 or Newer Chevrolet Tahoe, 4 WD 4 Door LTZ, as offered by the vendor, is in compliance with the specifications and will provide the Municipal Council, the Business Administrator and the Director of Purchasing with appropriate reports during the term of the contract.
5. A duly executed copy of the contract shall be forthwith filed in the Office of the City Clerk by the Director of Purchasing.
6. If required by State Law, the City shall provide the appropriate notice of award of this contract to the State Comptroller no later than 20 business days following such award. In accordance with N.J.S.A. 52:15C-10 and the Notice of the Office of the State Comptroller dated May 7, 2008.
STATEMENT
This resolution authorizes the acquisition of 5 (five) 2014 or Newer Chevrolet Tahoe, 4 WD, 4 Door LTZ, at a cost not to exceed $250,300.00, upon delivery, not to exceed December 31, 2015.
