WHEREAS, the United States Department of Homeland Security, Federal Emergency Management Agency, through the Port Authority of New York & New Jersey, has implemented the FY2014 Port Security Grant Program, Port of New York/New Jersey, to eligible municipalities and fire districts; and
 
WHEREAS, on or about November 3, 2014, on behalf of the City of Newark, the Director of the Newark Fire Department caused to be submitted an application to the United States Department of Homeland Security, Federal Emergency Management Agency, requesting grant funding in the total amount of $536,250.00 for the purchase of a Foam Delivery Unit (Fire Engine) (for which grant funds in the amount of $431,250.00 were requested), AA-AFFF Universal Goal Foam (for which grant funds in the amount of $101,250.00 were requested), and fuel for fire boats (for which grant funds in the amount of $3,750.00 were requested) as preventive measures in the consideration of the extreme amounts of combustible, flammable and hazardous cargo that are transported over the New Jersey Turnpike, US Route 280, New Jersey  Route 21, and US Routes 1 & 9 thoroughfares every day (a copy of the application is attached hereto and made a part hereof); and
 
WHEREAS, the grant funds would allow the City to purchase a much needed Fire Engine that would have the capability to apply a large amount of firefighting foam quickly and efficiently, thereby enhancing the Newark Fire Department's firefighting capability in the Port Newark/Newark Liberty Airport area as well as the surrounding areas; and
 
WHEREAS, as a result of the grant application, the United States Department of Homeland Security, Federal Emergency Management Agency, through The Port Authority of New York & New Jersey, awarded the City of Newark $536,250.00 in grant funds for the period commencing on September 1, 2014, and terminating on August 31, 2016 (a copy of the Grant Award Document is attached hereto and made a part hereof); and
 
WHEREAS, in order to receive the grant funds, the City must establish acceptance of the grant award; and
 
WHEREAS, the grant requires matching funds in the total amount of $178,750.00; and
 
WHEREAS, the Director of the City of Newark Fire Department recommends that the grant funds in the total amount of $536,250.00 be accepted; and
 
WHEREAS, pursuant to the City of Newark's Memorandum of Understanding with the State of New Jersey, the State Monitor has approved the acceptance of the grant funds (a copy of the State Grant Approval Form is attached hereto and made a part hereof).
 
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
 
1.      The Mayor and/or his designees, the Director and/or Deputy Chief of the Newark Fire Department, are hereby authorized to submit an application to the United States Department of Homeland Security, Federal Emergency Management Agency, through the Port Authority of New York & New Jersey, under the FY2014 Port Security Grant Program, requesting funding in the total amount of $536,250.00, with $178,750.00 of City funds required.
 
2.      The Municipal Council hereby ratifies its authorization of this application from the date of application submission to the date of adoption of this authorizing resolution.
 
3.      The grant award in the total amount of $536,250.00 is hereby accepted.
 
4.      The Mayor and/or his designees, the Director and/or Deputy Chief of the Newark Fire Department, are hereby authorized to enter into and execute grant agreements and documents with the United States Department of Homeland Security, Federal Emergency Management Agency, as may be needed to receive and expend the grant award in the total amount of $536,250.00 for the period commencing on September 1, 2014, and terminating on August 31, 2016.
 
5.      The grant agreements and documents between the City of Newark and the United States Department of Homeland Security, Federal Emergency Management Agency, are hereby ratified from the date of execution to the date of adoption of this authorizing resolution.
 
6.      Matching funds in the amount of $178,750.00 shall be provided from the following line appropriation of the municipal budget: Business Unit 051, Department G15, Division F15BO, Unclassified Operations account.
 
7.      The Director of the Fire Department shall file a fully-executed copy of the grant application, the award letter and the grant agreement in the Office of the City Clerk.
 
STATEMENT
 
      This resolution ratifies and authorizes the actions taken by the Director and/or Deputy Chief of the Newark Fire Department to submit an application for grant funding from the United States Department of Homeland Security, Federal Emergency Management Agency, for the purchase of a Foam Delivery Unit (Fire Engine), AA-AFFF Universal Goal Foam and fuel for fire boats, and furthermore ratifies and authorizes the Mayor and/or his designees, the Director and/or Deputy Chief of the Newark Fire Department, to enter into and execute grant agreements and documents with the United States Department of Homeland Security, Federal Emergency Management Agency, as may be needed to receive and expend the grant award in the total amount of $536,250.00 for the period commencing on September 1, 2014, and terminating on August 31, 2016.  Matching grant funds in the amount of $178,750.00 shall be provided from the municipal budget.
