Original Resolution 7R12-c(AS) adopted on December 18, 2019, awarded a contract in an amount not to exceed $323,790.00, for a period of 150 calendar days from the date of the issuance of a Notice to Proceed.

 

Change Order #1 will extend the completion time by 120 calendar days from the date of the issuance of a Notice to Proceed, with an end date of November 20, 2020.

WHEREAS, Resolution 7R12-c(AS) adopted on December 18, 2019, authorized the award of Contract 21-WS2009 to Rapid Pump and Meter Service Company, Incorporated, 285 Straight Street, P.O. Box AY, Paterson, New Jersey 07501, in the amount of Three Hundred Twenty-Three Thousand Seven Hundred Ninety Dollars and Zero Cents ($323,790.00) in accordance  with the Local Public Contracts Law, N.J.S.A. 40A:11-1 et seq.: and

 

WHEREAS, due to the Covid-19 pandemic, time delays occurred in the shipping and delivery of the spray wash pump equipment.  Also, changes were requested of the implementation of the SCADA system improvements, requiring extra time.

 

WHEREAS, Contract 21-WS2009 is to be amended with no change in the contract amount, and establishing an additional 120 calendar days for a total of 270 calendar days as the contract completion period; and

 

WHEREAS, the Department of Water and Sewer Utilities, wishes to execute Change Order #1 to Pequannock Screen Building Spray Wash Replacement - Contract 21-WS2009, Rapid Pump and Meter Service Company, Incorporated, 285 Straight Street, P.O. Box AY, Paterson, New Jersey 07501, with no change in the contract amount, and extending the completion contract period by 120 calendar days for a total of 270 calendar days from the date of the issuance of a Notice to Proceed; and

 

WHEREAS, the Municipal Council adopted the Contract Pay-to-Play Reform Ordinance R.O. 2;4-22 C, which forbids the award of a contract of a Business Entity, as defined therein, which has made or solicited political contributions to Newark Municipal Candidates, office holders having ultimate responsibility for the award of a contract; candidates committees of the aforementioned candidates, and political or political party committees of the City of Newark or County of Essex; and continuing political committees or political action committees regularly engaged in the support of  the City of Newark municipal or County of Essex elections; and certain other political party or candidate committees, in excess of certain thresholds. 

 

NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY THAT:

 

1.                     The Mayor and/or his designee, the Director of the Department of Water and Sewer Utilities, to execute Change Order #1 to Pequannock Screen Building Spray Wash Replacement - Contract 21-WS2009, with Rapid Pump and Meter Service Company, Incorporated, 285 Straight Street, P.O. Box AY, Paterson, New Jersey 07501 with no change of the contract amount and extending the completion contract period by 120 calendar days for a total of 270 calendar days from the date of the issuance of a Notice to Proceed.

 

2.                     No funds are required for Change Order #1.

 

3.                     The Director of the Department of Water and Sewer Utilities shall file a fully executed copy of Change Order #1 in the Office of the City Clerk.

 

4.                     This contract was solicited and awarded to the provisions of the Local Public Contract Law, N.J.S.A. 40A:11-1 et seq., and is in compliance with the City’s Contractor Pay-to-Play Reform Ordinance, R.O. 2:4-22C.

 

5.                     If required by State Law, the City Clerk shall provide the appropriate notice of the award of this contract to the State Comptroller no later than twenty (20) business days following such award, in accordance with N.J.S.A. 52:15C-10 and the Notice of the State Comptroller dated May 7, 2008.

 

 

STATEMENT

 

This resolution authorizes the Mayor and/or his designee, the Director of the Department of Water and Sewer Utilities, to enter into and execute Change Order #1 to Contract Pequannock Screen Building Spray Wash Replacement - Contract 21-WS2009 with Rapid Pump and Meter Service Company, Incorporated, 285 Straight Street, P.O. Box AY, Paterson, New Jersey 07501, with no change in the contract amount, and extending the completion contract period by 120 calendar days for a total of 270 calendar days from the date of the issuance of a Notice to Proceed.
