WHEREAS, the City of Newark (the “City”) has a need to provide Animal Shelter Management Services animals that are; a danger to human beings, injured, trapped, sick or endangered; and

                     

                     WHEREAS, the City desires to provide animal sheltering and impoundment services in order to protect the health, safety, and welfare of the citizens of the City of Newark pursuant to N.J.S.A. 40:48-2; and

                     

 WHEREAS, pursuant to N.J.S.A. 40:48-5.1 the City desires to enter into a contract for the period of May 1, 2025 through April 30, 2026, for a total amount not to exceed One Million Eight Hundred Forty Thousand Dollars and Zero Cents ($1,840,000.00); and

 

WHEREAS, pursuant to N.J.A.C. 5:30-5.5 et seq., the Contract is subject to the availability and appropriation of sufficient funds annually; and

 

WHEREAS, the Contract shall be awarded as an open-ended contract and shall not exceed One Million Eight Hundred Forty Thousand Dollars and Zero Cents ($1,840,000.00) for a one (1) year term.

 

NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:

 

1.                     The Mayor and/or his designee, and the Director of the Department of Health and Community Wellness, is hereby authorized to enter into and execute a contract with Associated Humane Societies, Inc., 124 Evergreen Avenue, Newark, New Jersey 07114, for a contract period commencing on  May 1, 2025 terminating on April 30, 2026, for a total contract amount not to exceed One Million Eight Hundred Forty Thousand Dollars and Zero Cents ($1,840,000.00), for animal sheltering and impoundment services in the City of Newark.

 

2.                     The Contract shall be ratified back to May 1, 2025, to the date of adoption of this Resolution.

 

3.                     The Contract is awarded as an open-ended contract pursuant to N.J.A.C. 5:30-5.5(b)(2). A Certification of Funds shall be executed each time services are used and charged against the contract.

 

4.                     Pursuant to N.J.A.C. 5:30-5.5,the Contract is subject to the availability and appropriations of sufficient funds annually.

 

5.                     Pursuant to N.J.S.A. 27:25-17, any and all debts, expenses or obligations incurred by the Department of Health and Community Wellness, shall be payable only from funds available to the City of Newark, and no liability or obligation shall be incurred by the Department of Health and Community Wellness beyond the extent to which monies are available.

 

6.                     Pursuant to N.J.A.C. 5:30-5.5(a), attached hereto is a partial Certification of Funds issued by the Director of the Department of Finance, which states that there are available sufficient legally appropriated funds; F2025 Budget/Department of Health and Community Wellness/ /NW011-200-2001-95920-B2025 ($306,666.66); the balance of funding for the Contract amount for 2026 will be subject to appropriation in the 2026 Budget and funds will be certified prior to services being provided by the contractor.

 

7.                     A copy of the executed Contract and the Certification of Funds shall be filed in the Office of the City Clerk by the Director of the Department of Health and Community Wellness.

 

8.                     If required by State Law, the City Clerk shall provide the appropriate notice of the award of the Contract to the State Comptroller no later than twenty (20) business days following such award, in accordance with N.J.S.A. 52:15C-10(a)and the Notice of the Office of the State Comptroller dated July 7, 2025.

 

 

STATEMENT

 

This Resolution ratifies and authorizes the Mayor and/or his designee, and the Director of the Department of  Health and Community Wellness, to enter into and execute an open-ended contract with the Associated Humane Societies, Inc., 124 Evergreen Avenue, Newark, New Jersey 07114, for the period commencing on May 1,2025 and terminating April 30, 2026, for a total amount not to exceed One Million Eight Hundred Forty Thousand Dollars and Zero Cents ($1,840,000.00), for animal sheltering and impoundment services in the City of Newark.
