Resolution 7R12-a adopted on August 2, 2017, awarded the contract in an amount not to exceed of $486,580.00. upon the issuance of a written Notice to Proceed, until the completion of the Project Construction, pursuant to N.J.S.A. 40A:11-15(9).

 

Amendment #1 adopted as Resolution 7R12-a on January 10, 2024, increased the contract amount by $479,227.00 for a new total contract amount not to exceed $965,807.00.

 

Amendment #2 will increase the contract amount by $353,325.00 for a new total contract amount not to exceed $1,319,132.00.

WHEREAS, resolution 7R12-a adopted on August 2, 2017, authorized the Director of the Department of Water & Sewer Utilities to executed a contract with Suburban Consulting Engineers, Inc., 96 U.S. Highway 206, Suite 101, Flanders, New Jersey 07836, pursuant to a fair and open process, to provide Professional Engineering Services for the Rehabilitation of Pequannock Aqueducts and Construction Inspection, in an amount not to exceed $486,580.00, for a contract term commencing upon the issuance of a Notice to Proceed until completion of project construction pursuant to N.J.S.A. 40A:11-15(9); and

 

WHEREAS, Amendment #1, by Resolution 7R12-a adopted January 10, 2024, increased the contract by $479,227.00, for a total contract amount not to exceed $965,807.00; and

 

WHEREAS, the City of Newark, is currently in the process of conducting the rehabilitation of Pequannock Aqueducts and construction inspection with the managerial assistance of Suburban Consulting Engineers, Inc.  Due to unforeseen conditions, the revision of locations for several proposed chambers to avoid excessive slope, change in diameter, unknown fittings, depth of cover over improvements at several site, and extensive lead time on materials, the project has incurred lengthy delays. Through this amendment, Suburban Consulting Engineers shall continue providing construction observation and construction administration; and

 

WHEREAS, due to the unforeseen conditions the original construction with a completion date was extended from January 27, 2026 to May 24, 2027, necessitating corresponding amendments to Suburban’s proposal for construction administration/management, including, additional construction meetings, monthly progress reports, anticipated additional change orders, increased hours of construction supervision and increased on-site inspection hours (All as more fully set forth in detailed Contract Amendment Request #2 dated May 21, 2026.); and   

 

WHEREAS, the Department of Water and Sewer Utilities wishes to execute Amendment #2 amending the scope of services and  increasing the contract amount by $353,325.00 with Suburban Consulting Engineers, Inc., to continue providing Professional Engineering Services for the Rehabilitation of Pequannock Aqueducts and Construction Inspection, until project completion per N.J.S.A. 40A:11-15(9) for a total contract amount not to exceed 1,319,132.00.

 

 

NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:

 

1.                     The Mayor of the City of Newark and/or his designee, the Director of the Department of Water and Sewer Utilities, are authorized to enter into and execute Amendment #2 with Suburban Consulting Engineers, Inc., 96 U.S. Highway 206, Suite 101, Flanders, New Jersey 07836, to continue to amend the scope of services as set forth in amendment request #2 dated May 21, 2026  for the Rehabilitation of Pequannock Aqueducts and Construction Administration and Inspection, for an additional $353,325.00, for a total contract amount not to exceed $1,319,132.00 until project completion per N.J.S.A. 40A: 11-15(9).

 

2.                     The contract is ratified from June 22, 2026, to the date of adoption of this authorizing resolution. 

 

3.                     Attached hereto is a Certificate of Funds from the Director of the of Finance of the City of Newark, which states that there are sufficient funds, in the amount of Three Hundred Fifty-Three Thousand Three Hundred Twenty Five Dollars and Zero cents ($353,325.00), from the Department of Water and Sewer Utilities/NW041-23W-23W00-94710-B2023 for the purpose set forth herein.  The Certification of Funds shall be filed along with the original resolution in the office of the City Clerk.

 

4.                     The Director of the Department of Water and Sewer Utilities shall file a duly executed copy of Amendment #2 in the Office of the City Clerk.

 

5.                     All other terms and conditions of the Contract remain the same.

 

6.                     A notice of this action shall be published in the newspaper authorized by law to publish a legal advertisement and as required by law within ten (10) days of its passage.

 

 

STATEMENT

 

This Resolution ratifies, amends and authorizes the Mayor of the City of Newark and/or his designee, the Director of the Department of Water and Sewer Utilities, to enter into and execute Amendment #2 with Suburban Consulting Engineers, Inc., to amend the scope of services for Professional Engineering Services for the Rehabilitation of Pequannock Aqueducts and Construction Inspection, and increase the contract amount by $353,325.00 for a total contract amount not to exceed $1,319,132.00, until project completion per N.J.S.A. 40A: 11-15(9).
