WHEREAS, Resolution 7R12-A - October 18, 2017, authorized the Director of Water and Sewer Utilities to execute an agreement with the State of New Jersey, Department of Transportation, for the verification, design, protection and/or relocation of certain public water facilities of the City’s water system to accommodate the design and construction of UECA-08-Intersection Improvement Program, Contract 2017-1-173010, located in City of Elizabeth and Linden City - Union County and Township of Parsippany-Troy Hills - Morris County; and
WHEREAS, on March 2, 2018 the City of Newark received two (2) contract agreement amendments with exhibits for UECA-08-Intersection Improvement Program, Contract 2017-1-173010; and
WHEREAS, the Contract Agreement Amendments are needed to cover the understandings between the State of New Jersey Department of Transportation and the City of Newark (Department of Water and Sewer Utilities) for the required Federal Regulations pursuant to 2 C.F.R. 200 and 2 C.F.R. 200 Appendix II and implementing regulations of the Federal Highways Administration procurement requirements; and
WHEREAS, the Department of Transportation, State of New Jersey, requires the City of Newark to enter into the attached agreement amendments for of UECA-08-Intersection Improvement Program, Contract 2017-1-173010.
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICPAL COUNCIL OF THE CITY OF NEWARK, NEW JESEY, THAT:
1. The Acting Director of the Department of Water and Sewer Utilities is hereby authorized, on behalf of the City of Newark, to execute the attached agreement amendments with the State of New Jersey, Department of Transportation, for the UECA-08-Intersection Improvement Program, Contract 2017-1-173010.
2. The Acting Director of the Department of Water and Sewer Utilities is further authorized to accept the completed project on behalf of the City of Newark, New Jersey.
3. This agreement amendment is entered pursuant to N.J.S.A. 40A:11:5(2) because it is another subdivision of the State of New Jersey.
4. No municipal funds are required for this agreement amendment.
5. The Acting Director of the Department of Water and Sewer Utilities shall file a fully executed copy of the agreement in the office of the City Clerk along with the resolution.
6. Contract term is until completion of State Project.
STATEMENT
This resolution authorizes the Acting Director of the Department of Water and Sewer Utilities, to execute the attached agreement amendments with the State of New Jersey, Department of Transportation, for the verification, design, protection and/or relocation of certain public water facilities of the City’s water system, to accommodate the design and construction of UECA-08-Intersection Improvement Program, Contract 2017-1-173010, located in City of Elizabeth and Linden City - Union County and Township of Parsippany-Troy Hills - Morris County until the completion of the State Project.
