WHEREAS, The Lincoln Park Coast Cultural District (“LPCCD”), a national non-profit organization with a long-standing presence in Lincoln Park, is dedicated to conserving land for recreation and open space purposes and has, in prior collaborations with the City of Newark (“City”), demonstrated its capability in maintaining, operating and improving parks; and

 

WHEREAS, in March 2023, the United States Department of Housing and Urban Development (HUD) announced funding in the amount of Three Million Five Hundred Fifty Thousand Dollars and Zero Cents ($3,550,000.00), through the Consolidated Appropriations Act, 2023 (P.L. 117-328) for the purpose of the Lincoln Park Restoration Project (“Project”); and

 

WHEREAS, the Project is the culmination of an eighteen-month community planning process involving the City, LPCCD, the New Jersey Department of Community Affairs, and other stakeholders; and

 

WHEREAS, pursuant to Resolution 7R11-a, adopted on April 02, 2025, the City accepted a grant award from HUD in the amount of Three Million and Five Hundred Fifty Thousand Dollars and Zero Cents ($3,550,000.00); and

 

                     WHEREAS, the approved Project Narrative which culminated in the City being awarded said grant included LPCCD as the primary implementation partner and sub-awardee of the grant funds; and

                     WHEREAS, as sub-awardee, LPCCD will be responsible for the day-to-day project management, coordination of contractors and vendors, community engagement, and execution of project activities; and

                     WHEREAS, the City desires to enter into a Sub-Grant Agreement with LPCCD to implement the Project and to, as grantee, maintain appropriate oversight of LPCCD to ensure (1) adherence to HUD’s Community Project Funding grant program requirements and (2) alignment with the Project’s approved Project Narrative.

 

 

NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:

 

1.                     In connection with the subaward of funds awarded by the United States Department of Housing and Urban Development for the Lincoln Park Restoration Project (“Project”), the Mayor and/or his designee, the Business Administrator are hereby authorized to enter into and execute the attached Sub-Grant Agreement with the Lincoln Park Coast Cultural District (LPCCD), having an address at 450 Washington Street Newark, New Jersey 07102.

 

2.                     The total amount paid to LPCCD pursuant to the Sub-Grant Agreement shall not exceed Three Million Dollars and Zero Cents ($3,000,000.00). Attached hereto is a Certification of Funds from the Chief Financial Officer of the City of Newark stating that sufficient Funds are available for the purposes stated in this Resolution from Account Line: NW051-G25-A25K0-A-71280-B2025

 

3.                     The term of the Sub-Grant Agreement shall commence on the date of adoption of this authorizing resolution and terminate on December 31, 2031.

 

4.                     The MOU and the actions taken by city officials and employees in furtherance of the Project are ratified back to August 20, 2025.

 

5.                     No substantial or material changes to the MOU may occur without the Municipal Council’s prior approval.

 

6.   A fully executed copy of the MOU authorized by this resolution shall be filed in the Office of the City Clerk by the Office of the Business Administrator.

 

 

STATEMENT

 

This resolution authorizes the Mayor and/or his designee, the Business Administrator to enter into and execute a Sub-Grant Agreement with the Lincoln Park Coast Cultural District, 450 Washington Street Newark, NJ 07102 for the rehabilitation, improvement and redevelopment of Lincoln Park, located at the intersection of Broad St. & Lincoln Park. The Sub-Grant Agreement is ratified to April 1, 2026.
