WHEREAS, New Jersey Transit’s Bus Safety Department conducted an investigation for proposed bus stop location changes due to safety concerns; and
WHEREAS, at the request of the Department of Engineering and review of the traffic operations by New Jersey Transit in conjunction with the City of Newark, Department of Engineering, Division of Traffic and Signals, and pursuant to N.J.S.A. 39:4-197(3)(a), the following described locations are added and deleted as a bus stop:
ADD BUS STOP:
1. In the Central Ward, along West Market, eastbound on the southerly side thereof:
a. Between Central Avenue and Littleton Avenue midblock.
Beginning 90ft east of the westerly curb line of Central Avenue and extending 135ft easterly therefrom.
DELETED BUS STOP:
2. In the Central Ward, along Central Avenue, eastbound on the southerly side thereof:
a. West Market Street, nearside.
Beginning at the westerly curb line of Central Avenue and extending 100ft westerly therefrom.
WHEREAS, pursuant to Section 39:4-197(3)(a) of Title 39 of the Revised Statutes of New Jersey, a municipality may by ordinance, resolution or regulation designate, relocate or delete a bus stop.
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. In the Central Ward, the following described location is hereby relocated as a bus stop:
From: along Central Avenue eastbound on the southerly side at West Market Street, nearside location. Beginning at the westerly curb line of Central Avenue and extending 100 feet westerly therefrom.
To: along West Market Street eastbound on the southerly side between Central Avenue and Littleton Avenue midblock location. Beginning 90ft east of westerly curb line of Central Avenue and extending 135 feet easterly therefrom.
2. No municipal funds expended for this act.
3. No amendment to this Resolution without the approval of the Municipal Council.
4. Upon approval, the Acting Director of the Department of Engineering will forward a copy of this Resolution to the Office of the City Clerk to notify them of the Local Government’s approval for the relocation of a bus stop as stated.
5. Upon approval, a certified copy of this Resolution shall be forwarded to New Jersey Transit to notify them of the Local Government’s approval for the relocation of a bus stop as stated.
6. Pursuant to N.J.S.A. 39:4-8(e) of Title 39 of the Revised Statutes of New Jersey, the proposed bus stop relocation does not require New Jersey Department of Transportation’s approval.
STATEMENT
This Resolution designates the relocation of a bus stop in the Central Ward as follows:
From: along Central Avenue eastbound on the southerly side thereof at West Market Street, at the nearside location, beginning at the westerly curb line of Central Avenue and extending 100 feet westerly therefrom.
To: along West Market Street eastbound on the southerly side thereof between Central Avenue and Littleton Avenue midblock location, beginning 90ft east of the westerly curb line of Central Avenue and extending 135 feet easterly therefrom.
