WHEREAS, the City’s Department of Engineering, Division of Traffic and Signals, is in need of professional services to prepare the preliminary engineering services, Final Design (FD) services and handle Construction Engineering Support (CE) services for the proposed City of Newark Safe Routes to Schools Design Assistance Program; and
WHEREAS, by Resolution 7R3-a dated March 3, 2021, the City of Newark accepted funds from the New Jersey Department of Transportation (NJDOT), in the amount of Three Hundred Ninety-Six Thousand Nine Hundred Dollars and Sixty-Eight Cents ($396,900.68), to provide for the Safe Routes to School Design Assistance program to provide for improvements that enable and encourage walking and bicycling to school; and
WHEREAS, on October 7, 2021, the City of Newark entered into Federal Aid Cost Reimbursement Agreement #2021-DT-DLA-552 with NJDOT, for the City of Newark Safe Routes to Schools Design Assistance Program, with a contract period of October 7, 2021 through November 15, 2023; and
WHEREAS, on May 17, 2024, without the need for application, the City received Agreement Modification No. 1 to Federal Aid Cost Reimbursement Agreement #2021-DT-DLA-552 (a copy the Agreement Modification is attached hereto and made a part hereof) from NJDOT extending the project until January 29, 2027; and
WHEREAS, the City wishes to appoint the Mayor of the City of Newark and/or his designee, the Acting Director of the Department of Engineering to act as the authorized person to execute the Agreement Modification No. 1 to Federal Aid Cost Reimbursement Agreement #2021-DT-DLA-552, which will extend the contract term until January 29, 2027 for the City of Newark Safe Routes to School- Design Assistance Program.
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. The Mayor of the City of Newark and/or his designee, the Acting Director of the Department of Engineering, are hereby authorized to accept from the New Jersey Department of Transportation (NJDOT) an extension of the grant contract term to January 29, 2027, for the City of Newark Safe Routes to School- Design Assistance Program.
2. The Mayor of the City of Newark and/or his designee, the Acting Director of the Department of Engineering, are hereby authorized on behalf of the City of Newark to enter into and execute Agreement Modification No. 1 to Federal Aid Cost Reimbursement Agreement #2021-DT-DLA-552 to accept the extension of the contract term to January 29, 2027, for the City of Newark Safe Routes to School- Design Assistance Program between the City of Newark and New Jersey Department of Transportation.
3. The Acting Director of the Department of Engineering shall file a fully executed copy of the grant agreement in the Office of the City Clerk.
STATEMENT
This Resolution authorizes the Mayor of the City of Newark and/or his designee, the Acting Director of the Department of Engineering, to accept an extension of the contract term for Federal Aid Cost Reimbursement Agreement #2021-DT-DLA-552 from the New Jersey Department of Transportation, for the City of Newark Safe Routes to School-Design Assistance Program, until January 29, 2027.
