WHEREAS, on or about March 11, 2016, the Department of Health and Community Wellness entered into Emergency Contract # E-2016-03 to allow for the staffing of per diem nurses by National Staffing Associates, Inc., of 80 Main Street, Suite 100, West Orange, New Jersey 07052, from February 1, 2016 through April 30, 2016 (a copy of said Emergency Contract # E-2016-03 is attached hereto and made a part hereof); and
WHEREAS, on August 3, 2016, the Municipal Council, through Resolution 7R1-h, authorized an extension of the Emergency Contract #E2016-03 from May 1, 2016 through December 31, 2016; and
WHEREAS, one of the primary functions of the Department of Health and Community Wellness is to provide medical and dental care to residents within the City of Newark, and it is vital for the health clinics to have an appropriate level of nursing staff to assist providers and patients at 110 William Street, Newark, New Jersey 07102, 394 University Avenue, Newark, New Jersey 07102, 140 Bergen Street, Newark, New Jersey 07103 and the Mobile Medical Van; and
WHEREAS, the Department of Health and Community Wellness is in immediate and emergent need of per diem nurse staffing services for the period of January 1, 2017 through June 30, 2017; and
WHEREAS, N.J.S.A. 40A:11-6 provides that emergency contracts may be entered into when an emergency affecting the public health, safety or welfare requires the immediate delivery of goods or the performance of services; and
WHEREAS, City Ordinance 6PSF-e, adopted April 6, 2011, Article 2:5-13.2(e)(1)(c) provides that no extension of an emergency contract shall be permitted without authorization by the Municipal Council by resolution; and
WHEREAS, the Department of Health and Community Wellness desires to extend Emergency Contract #E-2016-03 for the period of January 1, 2017 through June 30, 2017, in an amount not to exceed $245,000.00 to continue to provide nursing services until they can award a new contract; and
WHEREAS, N.J.A.C. 5:30:5-5(a) provides that municipalities may enter into contracts without a full Certification of Funds when the municipality is operating under a temporary budget, and the City of Newark is, in fact, currently operating under a temporary budget; and
WHEREAS, the New Jersey Department of Community Affairs has approved the above-described extension of the emergency contract (a copy of the New Jersey Department of Community Affairs Waiver is attached hereto and made a part hereof); and
WHEREAS, there was a delay in the City procuring new per diem staffing for Nursing and Advance Nurse Practitioner Services due to an ongoing litigation with a former nursing provider, that resulted in a settlement with the City; and
WHEREAS, per diem staffing for Nursing and Advance Nurse Practitioner services will be advertised for competitive bidding by the end of February, 2017.
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. The Mayor and/or his designee, the Business Administrator, are hereby authorized to extend Emergency Contract #E2016-03 with National Staffing Associates, Inc., of 80 Main Street, Suite 100, West Orange, New Jersey 07052, for the period of January 1, 2017 through June 30, 2017, in an amount not to exceed $245,000.00 to continue to provide nursing services until a new contract is awarded, but in no event later than December 31, 2017.
2. The above-described extension of Emergency Contract #E2016-03 is hereby ratified from January 1, 2017 to the date of adoption of this authorizing resolution.
3. Pursuant to N.J.A.C. 5:30-5(a), a Temporary Budget, attached hereto is a partial Certifications of Funds in the total amount of $122,500.00 from the Municipal Comptroller of the City of Newark, indicating that there are sufficient funds available for all liability to be incurred during the City of Newark’s temporary budget period, more specifically: [i] Certification of Funds in the amount of $122,500.00, Business Unit NW026, Activity A, Account # 46480, Budget Ref. B2016.
4. The continuation of Emergency Contract #E2016-03 beyond the City of Newark’s temporary budget period is subject to the appropriation of sufficient funds.
5. Immediately after the City of Newark adopts its final budget, a Certification of Funds shall be prepared for the remaining balance and filed by the Business Administrator on behalf of the Department of Health and Community Wellness with the original resolution in the Office of the City Clerk.
6. Copies of this resolution and the above-described extended Emergency Contract shall be filed with the Office of the City Clerk, by the Business Administrator on behalf of the Department of Health and Community Wellness.
STATEMENT
This resolution ratifies and authorizes the Mayor and/or his designee, the Business Administrator, to extend Emergency Contract #E2016-03 with National Staffing Associates, Inc., of 80 Main Street, Suite 100, West Orange, New Jersey 07052, for the provision of per diem nurse staffing services, for the period of January 1, 2017 through June 30, 2017, in an amount not to exceed $245,000.00 to continue to provide nursing services until a new contract is awarded, but in no event later than December 31, 2017.
