WHEREAS, on January 27, 2015, the City of Newark, through its Director of Purchasing, advertised to solicit bids for contractors to provide, a Citizens’ Emergency Alert System to the Office of Emergency Management and Homeland Security, as per the bid attached hereto; and
WHEREAS, the Division of Central Purchasing distributed eleven (11) bid proposal packages to prospective vendors following the date of advertisement; and
WHEREAS, on February 19, 2015 the Office of Emergency Management and Homeland Security received two (2) bids in response to this advertisement; and
WHEREAS, all bids were rejected due to a deficiency in the functionality of the specification as advertised and as such, the last advertisement did not produce a reliable vendor; and
WHEREAS, on July 14, 2015, the City of Newark through its Director of Purchasing advertised to solicit bids for contractors to provide, a Citizens’ Emergency Alert System to the Office of Emergency Management and Homeland Security as per the bid attached hereto; and
WHEREAS, the Division of Central Purchasing distributed eleven (11) bid proposal packages to prospective vendors following the date of advertisement; and
WHEREAS, on July 30, 2015, the Office of Emergency Management and Homeland Security received three (3) bids in response to this advertisement; and
WHEREAS, SwiftReach Network, Inc., 14 Industrial Avenue, Suite 4, Mahwah, New Jersey submitted the lowest responsive responsible bid at a cost not to exceed $96,000.00
WHEREAS, the Director of Emergency Management and Homeland Security reviewed the bids and recommends that an award be made to the lowest responsive responsible bidder SwiftReach Network, Inc., 14 Industrial Avenue, Suite 4, Mahwah, New Jersey, 07430; and.
WHEREAS, pursuant to N.J.S.A.19:44A-20.5 et seq., solicitations through public bidding in accordance with N.J.S.A. 40A:11-1 et seq. meets the requirements of the fair and open process.
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY THAT:
1. The Mayor and/ or his designee, the Purchasing Director, are hereby authorized to enter into a contract with SwiftReach Networks, Inc., 14 Industrial Avenue, Suite 4, Mahwah, New Jersey, 07430, to provide a Citizens’ Emergency Alert System to the City of Newark whose bid was received on the advertised due date and determined to be the lowest responsive responsible bidder in accordance with bid specifications. Upon adoption of the resolution by the Municipal Council the contract will be established for a two (2) year term
2. There shall be no amendment or change to this contract without the approval and consent of the Municipal Council.
3. Funds for the first year are encumbered on Requisition No. 19092, Fund NW051, Dept., G15 Project, A15D0, Account # 94130, Budget Reference B2015, for the total of $96,000.00.
4. It is responsibility of the Director of Office of Emergency Management and Homeland Security to ascertain that the network is in compliance with the specifications and will provide the Municipal Council, the Business Administrator and the Director of Purchasing with appropriate reports during the term of the contract.
5. The Director of Purchasing shall file a duly executed copy of the contract filed in the Office of the City Clerk.
6. If required by State Law, the City Clerk shall provide the appropriate notice of the award of this contract, to the State Comptroller no later than 20 business days following such award, in accordance with N.J.S.A. 52:15C-10 and the Notice of the Office of the State Comptroller dated May 7, 2008.
STATEMENT
This Resolution authorizes the Mayor and/ or his designee, the Purchasing Director, to enter into a contract with SwiftReach Networks, Inc., to provide a Citizens’ Emergency Alert System to the City of Newark, at a cost not to exceed $96,000.00 for a period of two (2) years upon adoption by the Municipal Council.
