WHEREAS, on behalf of the City of Newark, the Director of the Department of Public Safety submitted an application to the United States Department of Justice, Office of Justice Programs, Bureau of Justice Assistance, requesting funding in the amount of One Million Two Hundred Thousand Dollars and Zero Cents ($1,200,000.00) from the FY19 Comprehensive Opioid Abuse Site-based Program to fund a pre-arraignment diversion program, Newark Hope, that will assist individuals suffering from opioid drug dependency and misuse; and

 

WHEREAS, the goal of the program is to encourage and support the development of comprehensive, locally driven responses to the opioid epidemic that expands access to supervision, treatment, and recovery support services across the criminal justice system; support law enforcement and other first responder diversion programs for non-violent drug offenders; promote education and prevention activities; and address the needs of children impacted by the opioid epidemic.  All projects are expected to involve multiple agencies and partners; and

 

WHEREAS, the Newark Department of Public Safety, Police Division will work in partnership with the Essex County Prosecutors Office, Newark Community Solutions, the Center for Court Innovation, which will provide analytic and training support, and Rutgers University, which will serve as the research partner; and

 

WHEREAS, the City of Newark received notification of receipt of the grant award, Award Number 2019-AR-BX-K039, in connection with this application, for the period of October 1, 2019 through September 30, 2022; and

 

WHEREAS, the Director of the Department of Public Safety desires to accept the grant award and execute a grant agreement governing said award; and 

 

WHEREAS, the grant agreement for FY19 Comprehensive Opioid Abuse Site-based Program does not require City funds; and

 

WHEREAS, the Director of the Department of Public Safety is submitting a copy of the grant agreement to the Corporation Counsel and the Business Administrator for review, approval, and signature. 

 

NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:

 

1.                     The Mayor and/or his designee, the Director of the Department of Public Safety, are hereby authorized to submit an application to the United States Department of Justice, Office of Justice Programs, Bureau of Justice Assistance, requesting funding in the amount of One Million Two Hundred Thousand Dollars and Zero Cents ($1,200,000.00) from the FY 19 Comprehensive Opioid Abuse Site-based Program to fund a pre-arraignment diversion program, Newark Hope, that will assist individuals suffering from opioid drug dependency and misuse with no city funds required.

 

2.                     The Newark Municipal Council hereby ratifies its authorization of this application from the date of submission of the application to the date of adoption of this authorizing resolution.

 

3.                     The Mayor and/or his designee, the Director of the Department of Public Safety, are hereby authorized to accept grant funding in the amount of One Million Two Hundred Thousand Dollars and Zero Cents ($1,200,000.00) from the FY19 Comprehensive Opioid Abuse Site-based Program; a copy of the award letter is attached hereto and made a part hereof.

 

4.                     The Mayor and/or his designee, the Director of the Department of Public Safety, are hereby authorized to enter into and execute the grant documents with the United States Department of Justice, Office of Justice Programs, Bureau of Justice Assistance, to receive and expend the FY19 Comprehensive Opioid Abuse Site-based Program in the amount of One Million Two Hundred Thousand Dollars and Zero Cents ($1,200,000.00) to fund a pre-arraignment diversion program, Newark Hope, for the period of October 1, 2019 through September 30, 2022; a copy of the Agreement is attached hereto and made a part hereof. 

 

5.                     The Agreement between the City of Newark and the United States Department of Justice, Office of Justice Programs, Bureau of Justice Assistance is hereby ratified from October 1, 2019, to the date of adoption of this authorizing resolution.

 

6.                     The Director of the Department of Public Safety shall submit a complete copy of the grant agreement and any associated documents to both the Corporation Counsel and the Business Administrator for review, approval, and signature.

 

7.                     The Director of the Department of Public Safety shall file a fully-executed copy of the FY19 Comprehensive Opioid Abuse Site-based Program application, the grant award letter, and the grant agreement in the Office of the City Clerk.

 

 

STATEMENT

 

This resolution ratifies and authorizes the Mayor and/or his designee, the Director of the Department of Public Safety, to submit an application to accept, and enter into an agreement for the FY19 Comprehensive Opioid Abuse Site-based Program in the amount of One Million Two Hundred Thousand Dollars and Zero Cents ($1,200,000.00) from the United States Department of Justice, Office of Justice Programs, Bureau of Justice Assistance for the purpose of funding a pre-arraignment diversion program, Newark Hope, for the period commencing on October 1, 2019 through September 30, 2022, that will assist individuals suffering from opioid drug dependency and misuse. No municipal funds are required.
