WHEREAS, on October 30, 2025, the City’s, Department of Economic and Housing Development advertised a Request for Proposal (RFP) for Surveying Services with proposal packages available beginning on November 3, 2025, and a due date of November 17, 2025, in accordance with the requirements of the Local Public Contracts Law, N.J.S.A. 40A:11-1 et seq. (the “LPCL”); and
WHEREAS, the City received a total of two (2) proposals in response to its request by the RFP due date on November 17, 2025; and
WHEREAS, Neglia Group LLC, 34 Park Avenue, Lyndhurst, New Jersey 07071-1012 (“Neglia”), submitted a proposal and through a measured evaluation of all proposals submitted in responses to the RFP, the Department of Economic and Housing Development determined that Neglia was among the most qualified for the services requested; and
WHEREAS, Neglia’s proposal demonstrated the requisite range of engineering knowledge and skills, technical capability necessary to meet the City’s needs; and
WHEREAS, Surveying Services are professional services exempt from the public bidding requirements in accordance with N.J.S.A. 40A:11-5(1)(a)(i); and
WHEREAS, the City wishes to enter into a Professional Service Contract in an amount not to exceed Fifty-Five Thousand Dollars and Zero Cents ($55,000.00) with Neglia for Surveying Services for the period of January 1, 2026 through December 31, 2026; and
WHEREAS, the Contract is for an amount over $53,000.00 and is being awarded as a Fair and Open Contract pursuant to N.J.S.A. 19:44A-20.5 and is in compliance with the State Pay-to-Play; and
WHEREAS, the LPCL requires that notice of the award of contracts for “Professional Services” without competitive bidding must be published in a local newspaper.
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. The Mayor and/or his designee, the Deputy Mayor/Director of the Department of Economic and Housing Development, are hereby authorized and directed, on behalf of the City of Newark, to enter into and execute an Agreement with Neglia Group LLC, 34 Park Avenue, Lyndhurst, New Jersey 07071-1012 (“Neglia”), to provide Surveying Services, for the period of January 1, 2026 through December 31, 2026.
2. The Contract between the City of Newark and Neglia is hereby ratified from January 1, 2026 to the date of adoption of this authorizing Resolution.
3. The Contract shall be for an amount not to exceed Fifty-Five Thousand Dollars and Zero Cents ($55,000.00).
4. The Contract is being awarded pursuant to the Fair and Open Procedures of the State Pay-to-Play Law (N.J.S.A. 19:44A-20.5) and pursuant to the provisions of the Local Public Contacts Law (N.J.S.A. 40A:11-5(1)(a)(i)).
5. Attached hereto is a Certification of Funds from the Director of Finance, which states that: 1) there are sufficient funds in the amount of Fifty-Five Thousand Dollars and Zero Cents ($55,000.00) for the purpose set forth herein above; and 2) the line appropriation which shall be charged is as follows:

6. The Deputy Mayor/Director of the Department of Economic and Housing Development shall file a fully executed copy of the Contract, the Certification of Funds along with a certified copy of this Resolution in the Office of the City Clerk, to be made available for public inspection.
7. There shall be no advance payments against the Contract pursuant to N.J.S.A. 40A:5-16.
8. There shall be no amendments or changes to the Contract without the approval of the Municipal Council.
9. A notice of this action shall be published in the newspaper authorized by law to publish a legal advertisement and as required by law within ten (10) days of the adoption of this Resolution.
STATEMENT
This Resolution ratifies and authorizes the Mayor and/or his designee, the Deputy Mayor/Director of the Department of Economic and Housing Development to enter into and execute a Contract with Neglia Group LLC, 34 Park Avenue, Lyndhurst, New Jersey 07071-1012, to provide Surveying Services in an amount not to exceed Fifty-Five Thousand Dollars and Zero Cents ($55,000.00), for Contract Period of January 1, 2026 through December 31, 2026.
