WHEREAS, residents of the City of Newark ("City") are responsible for the maintenance and repair of water and sewer lines that are on their property and under portions of the City's right of way; and
WHEREAS, water and sewer lines on private property can vary widely in age and condition, resulting in substantial cost to residents when there is a malfunction of these lines on residential property; and
WHEREAS, the National League of Cities ("NLC") has introduced a program as a resource for residential property owners to obtain warranties to cover water and sewer line repair or maintenance; and
WHEREAS, the Mayor and members of the City Council recognize the need for the residents to have access to various tools to reduce the costs of their water and sewer line repairs and maintenance and want to bring the NLC program to the attention of City residents; and
WHEREAS, the Mayor and City Council have agreed to provide Utility Service Partners (USP) with a limited license to use the City's trademark on pre-approved letters to alert City residents of the availability of the sewer and water service line warranty program; and
WHEREAS, USP d/b/a Service Line Warranties of America (SLWA) will remit to the City license fees and ongoing annual payments as consideration for the license to use the City's trademark.
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
That the City of Newark enter into a marketing agreement with Utility Service Partners, Inc d/b/a Service Line Warranties of America, to license the use of the City trademark on four letters per year in an effort to make the homeowners of Newark, NJ, aware of the optional National League of Cities Service Line Warranty Program, for a period of three (3) years, with multiple one-year renewal options.
BE IT FINALLY RESOLVED, that the Mayor is authorized to issue a limited license to USP d/b/a SLWA for the use of the City's trademark in conjunction with SLWA's advertisements of the water and sewer line warranty program.
STATEMENT
This resolution will make it possible for homeowners in the City of Newark to participate in the National League of Cities Service Line Warranty Program which will provide financial assistance in the event of a malfunction of a water or sewer line on residential property.
