            WHEREAS, an emergency has arisen in Special Item of Appropriation in the amount of $7,396,358.00 bringing total program resources to $12,726,161.00, for the HIV Emergency Relief Program and no adequate provision has been made in the 2013 Temporary Budget for the aforesaid purpose and N.J.S.A. 40A: 4-20 provides for the creation of an emergency appropriation for the purpose above-mentioned; and
 
            WHEREAS, by authorizing Resolution 7R2-A dated May 1, 2013, the City of Newark accepted the HIV Emergency Relief Grant in the amount of $5,329,803.00 from the U.S. Department of Health and Human Services/Health Resources and Services Administration, for the provision of health care and supportive services to the residents of the City of Newark (Citywide) and also authorized the Director of the Department of Child to accept additional grant funds as they became available; and
 
            WHEREAS, N.J.S.A. 40A: 4-20 provides that the Governing Body by a two-thirds vote may make temporary emergency appropriations for any purpose for which appropriations may lawfully be made for the period between the beginning of the current fiscal year and the date of the adoption of the budget for said year; and
 
            WHEREAS, emergency appropriation adopted in 2013, pursuant to N.J.S.A. 40A: 4-20 including this resolution total…………………$288,509,021.51.
 
            NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
 
No less than two-thirds of all members thereof affirmatively concurring:
 
 
            1.   A temporary emergency appropriation be and the same is             
                            hereby made for the following classification:
 
                  Program                         Amount
 
                     HIV Emergency                                       $7,396,358.00
                  Relief Program            
            
  1. Said emergency appropriation shall be provided for in the 2013 budget.
  1. A copy of this resolution shall be filed with the Director of Local Government Services by the City Clerk of the City of Newark.
 
 
STATEMENT
 
This resolution hereby authorizes and establishes the appropriation for the HIV Emergency Relief Program in the amount of $7,396,358.00 bringing total program resources to $12,726,161.00. The U.S. Department of Health and Human Services/Health Resources and Services Administration have awarded these grant funds. The project period is from March 1, 2013 through February 28, 2014.
