WHEREAS, the State of New Jersey Department of Transportation ("NJDOT") State Aid to Counties and Municipalities FY2015 Municipal Aid Program ("NJDOT Municipal Aid Program") provides grant funding for the improvement and construction of local, municipal, and county road and bridge projects; and
WHEREAS, on October 9, 2014, on behalf of the City of Newark, the Director of the Department of Engineering, submitted an application to NJDOT requesting grant funding in the amount of $1,739,000.00 from the NJDOT Municipal Aid Program for Resurfacing of Various Streets - 2015 (12 locations) MA-15 Newark Project within the City of Newark, identified as application MA-2015-Resurfacing of Various Streets - 201-00585 for City of Newark, with no City funds required; and
WHEREAS, pursuant to Resolution 7R4-a adopted December 17, 2014 the City of Newark ratified and authorized the Mayor and or his designees, the Director of the Department of Engineering, to submit an application for grant funding from the New Jersey Department of Transportation (NJDOT) for the NJDOT Municipal Aid Program for improvements to various streets (12 locations) within the City of Newark, in the amount of $1,739,000.00; and
WHEREAS, the City of Newark received notice on April 10, 2015 (a copy of the NJDOT approval letter is attached hereto and made a part hereof) that it has been awarded a grant in the amount of $1,341,640.00 from the NJDOT Municipal Aid Program for improvements to various streets (12 locations) within the City of Newark, with no City funds required; and
WHEREAS, the Department of Engineering wants to amend Resolution 7R4-a adopted December 17, 2014, to execute an agreement with and accept grant funds in the amount of $1,341,640.00 from the NJDOT Municipal Aid Program for improvements to various streets (12 locations) within the City of Newark.
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:

- The Mayor and/or his designee, the Director of the Department of Engineering, are hereby authorized to accept the grant award in the amount of $1,341,640.00 from the New Jersey Department of Transportation(a copy of the NJDOT grant award approval letter is attached hereto and made a part hereof).

- The Mayor and/or his designee, the Director of the Department of Engineering, are hereby authorized to enter into and execute grant documents with the New Jersey Department of Transportation to receive and expend the grant award in the amount of $1,341,640.00 from the NJDOT Municipal Aid Program for improvements to various streets (12 locations) within the City of Newark.

- This grant is ratified from October 9, 2014 until the date of adoption of this authorizing resolution.
- No municipal funds are required for receipt or acceptance of this grant award.

- The Director of Engineering shall file a fully-executed copy of the grant application, the grant award letter, the final authorization letter, and the grant/project agreement in the Office of the City Clerk.
STATEMENT
This resolution amends Resolution 7R4-a adopted December 17, 2014, and ratifies and authorizes the actions taken by the Director of the Department of Engineering to submit an application for grant funding from the NJDOT Municipal Aid Program for improvements to various streets (12 locations) within the City of Newark, and furthermore, ratifies and authorizes the Mayor and/or his designee, the Director of the Department of Engineering, to enter into and execute an agreement with and accept grant funds in the amount of $1,341,640.00. No municipal funds are required for receipt or acceptance of this grant award.
