                          WHEREAS, an emergency has arisen in Special Item of Appropriation for $492,000.00, for the Water Monitoring Program to purchase water loss monitoring equipment.  and no adequate provision has been made in the 2026 Temporary Budget for the aforesaid purpose; and

 

                     WHEREAS, N.J.S.A. 40A:4-20 provides for the creation of an emergency appropriation for the purpose above-mentioned; and

                                          

                     WHEREAS, by the award notice issued September 1, 2025, the U.S. Environmental Protection Agency (EPA) has awarded the City of Newark for the Water Monitoring Program to purchase water loss monitoring equipment. funding in the amount of $492,000.00 to procure and deploy advanced acoustic leak detection equipment to address significant Non-Revenue Water (NRW) loss within its aging water distribution system. Newark currently experiences an NRW rate of approximately 36%, well above the industry benchmark of 15-17%, resulting in substantial financial losses, inefficient operations, and increased risk of infrastructure failure; and

 

                     WHEREAS, N.J.S.A. 40A:4-20 provides that the Governing Body by a two-thirds vote may make temporary emergency appropriations for any purpose for which appropriations may lawfully be made for the period between the beginning of the current fiscal year and the date of the adoption of the Budget for said year; and

 

                     WHEREAS, emergency appropriations adopted in 2026, pursuant to N.J.S.A. 40A:4-20, including this Resolution total $492,000.00.

 

                 NOW THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:

 

1.                     A temporary emergency appropriation be and the same is 

                              hereby made for the following classification:

2.                     Said emergency appropriation shall be provided for in the 2026 Budget.

 

3.                     A copy of this Resolution shall be immediately filed with the Director of Local Government Services by the City Clerk.

 

 

STATEMENT

 

This Resolution establishes a revenue and appropriation to provide for the Water Monitoring Program to purchase water loss monitoring equipment in the amount of $492,000.00.   The U.S. Environmental Protection Agency (EPA) is providing the grant funds. The project period is upon completion.
