AN ORDINANCE AMENDING AND SUPPLEMENTING TITLE 8, BUSINESSES AND OCCUPATIONS, CHAPTER 25, VENDOR LICENSES FOR THE SALE OF FOOD AND MERCHANDISE AT PUBLIC FESTIVALS, OF THE REVISED GENERAL ORDINANCES OF THE CITY OF NEWARK, NEW JERSEY, 2000, AS AMENDED AND SUPPLEMENTED, TO ESTABLISH A SEASONAL FESTIVAL ENDORSEMENT FOR MOBILE VENDORS.

WHEREAS, the City of Newark (“City”) regulates hawkers, peddlers, and mobile food vendors under Chapter 8:7, Hawking and Peddling; Canvassing and Soliciting, of the Revised General Ordinances, which provides for annual licensing, fees, and inspections; and
WHEREAS, the City also regulates vending at temporary events and festivals under Chapter 8:25, Vendor Licenses for the Sale of Food and Merchandise at Public Festivals, requiring a daily festival vendor license fee; and
WHEREAS, vendors who already maintain a valid annual license under Chapter 8:7 are subject to duplicate fees when they participate in City-approved festivals, despite already undergoing health, fire, zoning, and police inspections; and
WHEREAS, the Municipal Council finds it to be in the public interest to streamline this process by creating a Seasonal Festival Endorsement, which will allow annual license holders to participate in festivals upon payment of a single seasonal fee, while continuing to require registration and compliance with all health, sanitation, fire, and safety regulations.
NOW, THEREFORE, BE IT ORDAINED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:

Section 1. Title 8, Business Regulations and Licenses, Chapter 25, Vendor Licenses for the Sale of Food and Merchandise at Public Festivals, of the Revised General Ordinances of the City of Newark, New Jersey, 2000, as amended and supplemented, is amended as follows:
§ 8:25-3.1 Seasonal Festival Endorsement.
A. A vendor who holds a valid and current annual license under Chapter
8:7 (Hawkers and Peddlers) may obtain a Seasonal Festival Endorsement. The endorsement shall allow participation in all City-approved festivals during the license year without payment of the daily festival vendor license fee required by § 8:25-3.
B. The Seasonal Festival Endorsement shall be issued upon payment of a one-time seasonal fee of $500, in addition to the annual license fee required under Chapter 8:7, and shall be valid for a period of one year from the date of issuance
C. Vendors holding a Seasonal Festival Endorsement must register with the Division of Special Taxes, or such other department as may be designated, prior to each festival event. Registration shall be for the purpose of assignment of vending location and verification of compliance with all health, fire, and sanitation requirements.
D. Vendors who do not hold a valid annual license under Chapter 8:7 shall continue to be subject to the per-day festival vendor license fee established in § 8:25-3.
Section 2. Any ordinance or parts of any ordinance inconsistent with the provisions of this Ordinance are hereby repealed to the extent of such inconsistency.
Section 3. If any Section, paragraph, subparagraph, clause, or provision of this Ordinance shall be adjudged invalid, such adjudication shall apply only to the specific section, paragraph, subparagraph, clause, or provision so adjudged, and the remainder of the ordinance shall be deemed valid and effective.
Section 4. This Ordinance shall become effective upon its passage and publication pursuant to law.
STATEMENT
This Ordinance amends Title 8, Business Regulations and Licenses, Chapter 25, Vendor Licenses for the Sale of Food and Merchandise at Public Festivals, of the Revised General Ordinances of the City of Newark, New Jersey, 2000, to establish a Seasonal Festival Endorsement. The endorsement permits vendors already licensed under Chapter 8:7 (Hawkers and Peddlers) to participate in all City-approved festivals during the license year by paying a single seasonal fee, instead of a per-day festival license fee. Vendors must still register for each festival and remain subject to all health, fire, sanitation, and public safety requirements.
