WHEREAS, an emergency has arisen in Special Item of Appropriation in the amount of Five Million Three Hundred Nineteen Thousand Four Hundred Twenty-Nine Dollars and Zero Cents ($5,319,429.00) for Housing Opportunities for Persons with AIDS (HOPWA) and no adequate provision has been made in the 2023 Temporary Budget for the aforesaid purpose and N.J.S.A. 40:4-20 provides for the creation of an emergency appropriation for the purpose above-mentioned; and
WHEREAS, by resolution 7R1-h adopted on March 1, 2023, the City of Newark accepted the Housing Opportunities for Persons with AIDS (HOPWA), in the amount of Five Million Three Hundred Nineteen Thousand Four Hundred Twenty-Nine Dollars and Zero Cents ($5,319,429.00) from the United States Department of Housing and Urban Development (HUD); and
WHEREAS, N.J.S.A 40A:4-20 provides that the Governing Body, by a two-thirds vote, may make temporary emergency appropriations for any purpose for which appropriations may lawfully be made for the period between the beginning of the current fiscal year and the date of the adoption of the budget for said year; and
WHEREAS, the emergency appropriation adopted in 2023, pursuant to N.J.S.A. 40A:4-20 including this Resolution total is $ 244,264,483.93.
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. An emergency appropriation be and the same is hereby made for the following classification:
Program Amount
Housing Opportunities for Persons $5,319,429.00
with AIDS (HOPWA)
2. Said emergency appropriation shall be provided for in the 2023 budget.
3. A copy of this Resolution shall be filed with the Director of Local Government Services by the Acting City Clerk.
STATEMENT
This Resolution establishes the temporary emergency appropriation for $5,319,429.00 for the Housing Opportunities for Persons with AIDS (HOPWA). Funding has been provided by the United States Department of Housing and Urban Development (HUD) Program. The grant period is September 1, 2022 through August 31, 2023.
