Additional Information:
To utilize Sole Source Provider ForceMetrics Inc. for the purchase of proprietary cloud-based web applications Computer-Aided Dispatch “CAD”, Records Management Systems “RMS”, Jail Management Systems “JMS” in addition to other related data systems for the City of Newark Department of Public Safety. This contract is an exception to public bidding pursuant to N.J.S.A. 40A:11-5(1)(dd).

WHEREAS, the Department of Public Safety is committed to ensuring that the City of Newark (“City”) has access to web-based application software providing law enforcement entities unified search capabilities, visualization of public safety data, and data linkage from multiple existing data sources related to community impact, operational efficiencies, and performance metrics (“Software Solution”) in order to identify community needs, measure success and mitigate risks, together with standard support services; and
WHEREAS, the Director of the Department of Public Safety seeks to enter into a contract with ForceMetrics Inc. 2590 Welton Street Suite 200 Denver, CO 80205, for the provision of cloud-based web applications CAD, RMS, JMS, and related data systems for an amount not to exceed One Million Two Hundred Thousand Dollars and Zero Cents ($1,200,000.00), for the period commencing December 1, 2025 and terminating on November 30, 2026; and
WHEREAS, this Subscription Agreement is essential for the Department of Public Safety, to continue utilizing cloud-based web applications CAD, RMS, JMS, and related data systems; and
WHEREAS, ForceMetrics Inc. has represented that it is qualified by their training and experience to provide the required services and that it is the sole source provider of the aforementioned goods and services; and
WHEREAS, pursuant to the Local Public Contracts Law, N.J.S.A. 40A:11-5(1)(dd) a contract for goods and services in support of proprietary hardware and software may be awarded as an exception to public bidding;
WHEREAS, this contract is being awarded pursuant to a “Non-Fair and Open” process under State Pay-to-Play Law, N.J.S.A. 19:44A-20.5 and the Contractor Pay-to-Play Reform Ordinance, Newark Municipal Code § 2:4-22C.
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. The Mayor of the City of Newark and/or his designees, the Qualified Purchasing Agent, QPA and/or the Business Administrator are hereby authorized to enter into and execute a contract with ForceMetrics Inc. 2590 Welton Street Suite 200 Denver, CO 80205, for the provision of cloud-based web applications CAD, RMS, JMS, and other data systems, for an amount not to exceed One Million Two Hundred Thousand Dollars and Zero Cents ($1,200,000.00) for the period commencing on December 01, 2025, and terminating on November 30, 2026.
2. This contract is ratified from December 01, 2025, to the date of the adoption of this authorizing Resolution.
3. This contract is being awarded pursuant to the Non-Fair and Open Procedures of State Pay-to-Play Law, N.J.S.A. 19:44A-20.5, and in accordance with the provisions of Local Public Contracts Law, N.J.S.A. 40A:11-5(1)(dd) and is in compliance with the contractor Pay-to-Play Reform Ordinance § 2:4-22C.1,
4. The Director of the Department of Public Safety certifies that the services are essential and necessary for the conduct of the Department’s affairs and the Municipal Council concurs that the services are necessary for the conduct of the City’s affairs, pursuant to N.J.S.A. 40A:11-2(39).
5. There shall be no advance payments made against this contract in accordance with N.J.S.A. 40A:5-16.
6. The Business Entity Disclosure Certification and the Determination of Value shall be placed on file with the Office of the City Clerk by the Director of the Department of Public Safety.
7. A duly executed copy of the contract shall be filed in the Office of the City Clerk by the Director of the Department of Public Safety.
8. Notice of this action shall be published in the newspaper authorized to publish legal advertisements as required by the law within ten (10) days of the date of adoption.
9. A copy of the executed contract authorized herein shall be filed with the Office of the City Clerk.
STATEMENT
This Resolution ratifies and authorizes the Mayor of the City of Newark and/or his designee, the Director of the Department of Public Safety/Police Division to enter into and execute a contract with ForceMetrics Inc. 2590 Welton Street Suite 200 Denver, CO 80205, for the provision of cloud-based web applications CAD, RMS, JMS, and other data systems for the Department of Public Safety, at an amount not to exceed One Million Two Hundred Thousand Dollars and Zero Cents ($1,200,000.00) for the period commencing on December 01, 2025, and terminating on November 30, 2026.
