   WHEREAS, Resolution No. 7R4-A, adopted March 20, 2013, authorized the Director of the Department of Engineering to accept the bid proposal and execute Contract No. 08-2010, Wilson Avenue Reconstruction Eastern Phase Project with Underground Utilities Corp., 711 Commerce Road, Linden, New Jersey 07036, in an amount not to exceed $2,747,825.80; and
 
WHEREAS, a Notice to Proceed was issue on July 22, 2013, which date constituted the commencement of the contract term, which was 365 days hence; and
 
WHEREAS, due to delays due to weather and heavy traffic conditions within the work site, the Department of Engineering wishes to extend the contract term through December 1, 2014, in order to complete all street resurfacing along Wilson Avenue, complete all punch list items and allow the New Jersey Department of Transportation to perform final inspection on the project; and
 
WHEREAS, this Change Order No. 1 will not increase the total contract amount; and
 
WHEREAS, the attached Change Order No. 1 to Contract No. 08-2010, Wilson Avenue Reconstruction Eastern Phase Project extends the time to complete this contract to December 1, 2014.
 
 
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
 
 
1.      The Mayor and/or his designee, the Acting Director of the Department of Engineering, is hereby authorized on behalf of the City of Newark to issue and execute Change Order No. 1 to Contract No. 08-2010, Wilson Avenue Reconstruction Eastern Phase Project, extending the term of the contract through December 1, 2014, due to weather and heavy traffic conditions.
 
2.      The execution of Change Order No. 1 is hereby ratified from July 22, 2013 to the date of the adoption of this authorizing resolution.
 
3.      Consistent with the provisions of the Local Public Contracts Law, N.J.S.A. 40:A:11-15(9), the Director of the Department of Engineering is authorized to extend the term of a contract until the time of the completion of actual construction.
 
 
STATEMENT
 
This Resolution ratifies and authorizes the Mayor and/or his designee, the Director of the Department of Engineering, to issue and execute Change Order No. 1 to Contract No. 08-2010, Wilson Avenue Reconstruction Eastern Phase Project, extending the term of the contract through December 1, 2014.
