WHEREAS, Resolution 7R12-a 041515, adopted April 15, 2015 authorized the award to provide Corrective Technical Assistance (CTA) for the Newark Pequannock Water Treatment Plant to H2M Associates, Inc., 119 Cherry Hill Road, Suite 200, Parsippany, New Jersey 07054, and the amount not to exceed $182,000.00, in accordance with Local Public Contracts Law N.J.S.A. 40A:11-1 et seq; and
WHEREAS, as a result of the following unforeseen reasons additional tasks were necessary to successfully complete the project; and
WHEREAS, on two separate occasions, the City received two notices of violations for Total Trihalomethanes (TTHM) exceedance level from the New Jersey Department of Environmental Protection (NJDEP); and
WHEREAS, it was urgent for the Department of Water and Sewer Utilities to perform a study on TTHM and report to NJDEP; and
WHEREAS, on February 2016, a complimentary effort of $78,000.00 was authorized for H2M and Carollo team, to address additional scope requirements to study mitigation strategies to address the formation of disinfection byproducts, specifically TTHM’s; and
WHEREAS in order to pursue the optimization goals to the Pequannock Water Treatment Plant recommended in the CTA, H2M Associates, Inc. has begun an effort to provide field assistance to guide the City through tasks that allow optimization; and
WHEREAS, several tasks will be performed in order to achieve optimization at the Pequannock Water Treatment Plant:
Phase 1: Rate-of-Flow Filter Operation Improvements - The filters are currently operated in a declining rate filtration mode. It is recommended that the filters be operated in a level rate-of-flow control. By implementing this change in control philosophy, the City can expect increased filter production, increased unit filter run volumes, and a reduction in the number of backwashes required per day.
Phase 2: Filter Gallery Valve Replacement - A significant number of valves in the filter gallery are leaking or failing. The amount of leakage is substantial and induces a burden on plant operations. The leakage consumes volume in the wash water equalization basins and residuals handling facilities, and the lost water reduces the production efficiency of the plant. H2M Associates, Inc., will detail a typical valve replacement and typical appurtenances, and work with the City to develop correct, efficient, and useful schedule of bid items, so that the City maintains maximum flexibility and control the bidding and installation process.
Phase 3: Filter Surface Wash and Backwash Flow Meters - H2M Associates, Inc., will work with the plant operations staff to review and identify present and future surface and backwash flow rates; and
WHEREAS, the Department of Water and Sewer Utilities wishes to execute Change Order No. 1, Corrective Technical Assistance for the Newark Pequannock Water Treatment Plant with H2M Associates, Inc., The Director of the Department of Water and Sewer Utilities requests an extension of the contract term for an additional year, from October 15, 2016 to October 15, 2017 in order for H2M Associates, Inc. to successfully complete the professional services contract as permitted by the Local Public Contracts Law, N.J.S.A. 40A:11-15 (9), subject to Municipal Council approval; and
NOW THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. The Mayor and/or his designee, the Director of the Department of Water and Sewer Utilities, is hereby authorized, on behalf of the City of Newark, to issue Change Order No. 1 for a one (1) year extension of the term of the contract for Corrective Technical Assistance for the Newark Pequannock Water Treatment Plant to H2M Associates, Inc., 119 Cherry Hill Road, Suite 200, Parsippany, New Jersey 07054, from October 15, 2016 to October 15, 2017, for an amount not to exceed $78,000.00
2. The Municipal Council hereby ratifies the contract extension from October 15, 2016 to the date of adoption of this authorizing resolution.
3. A fully executed copy of Change Order No. 1/Contract Amendment shall be filed in the Office of the City Clerk by the Director of the Department of Water and Sewer Utilities.
4. No other changes to this contract are allowed without prior Municipal Council approval.
5. Any further extensions, as may be permitted by N.J.S.A. 40A:11-15 (9) are subject to Municipal Council approval.
6. If required by State Law, the City Clerk shall provide the appropriate notice of the award of this contract to the State Comptroller no later than twenty (20) business days following such award, in accordance with N.J.S.A. 52:15C-10 and the notice of the Office of the State Comptroller dated May 7, 2008.
7. Pursuant to N.J.A.C. 5:30-5.5, attached hereto is a Certification of Funds issued by the Director of Finance of the City of Newark which states that funds in an amount of $ 78,000.00 are available in the 2016 Budget, Business Unit NW037, Department ID: 750, Division 7502, Account # 71280. The Director of the Water and Sewer Utilities shall file a copy of the Certification of Funds along with the original resolution and the executed contract in the Office of the City Clerk.
STATEMENT
This resolution ratifies and authorizes the Mayor and/or his designee, the Director of the Department of Water and Sewer Utilities, to amend Corrective Technical Assistance for the Newark Pequannock Water Treatment Plan with H2M Associates Inc, 119 Cherry Hill Road, Suite 200, Parsippany, New Jersey 07054 by executing Change Order No. 1, for one (1) year extension to the contract term, from October 15, 2016 to October 15, 2017.
