WHEREAS, provisions of N.J.A.C. 5:23-4.20 authorizes the appointment of private on-site inspection and plan review agencies for the purpose of contracting with municipalities in order to act in the place of an Elevator Sub-Code Official; and
WHEREAS, the City of Newark desires to appoint a private on-site inspection agency to act in the capacity of an Elevator Sub-Code Official; and
WHEREAS, on February 28, 2012, the Department of Engineering, City of Newark, consistent with the Local Public Contracts Law, N.J.A.C. 40A:11-1, et seq., N.J.A.C. 52-27D-124.3 et seq., and the Fair and Open Process of the State of New Jersey Pay-to-Play Law, N.J.S.A 19:44A-20.5 et seq., advertised for the receipt of Request for Proposals (RFP) for Contract #05-2012 Third Party Elevator Sub-Code Inspections and Plan Review Services (under State of New Jersey Uniform Construction Code Rules and Regulations); and
WHEREAS, three (3) firms picked-up the RFP Packages; and
WHEREAS, on March 15, 2012, one (1) RFP bid was submitted; and
WHEREAS, after a review of the one (1) bid received by the Director of Engineering and the Construction Official, of the City of Newark's Uniform Construction Code Office, it was decided that it is in the best interests of the City of Newark, to accept the proposal submitted by EIC Inspection Agency Corporation, 3705 Kennedy Boulevard, Jersey City, NJ 07307, and to execute Contract #05-2012 Third Party Elevator Inspections and Plan Review Services and with them to function as Elevator Sub-Code Official for 64% (sixty-four per cent) of the fee to be charged by them, based on the schedule of fees for elevator inspections approved by the Department of Community Affairs, who are the state agency to set the fee structure for elevator inspections and plan review services in the State of New Jersey.
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OOF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. The Mayor and the Director of the Department of Engineering is hereby authorized on behalf of the City of Newark to accept the attached proposal dated March 15, 2012, and execute Contract #05-2012 Third party Elevator Inspections and Plan review Services and to function as Elevator Sub-Code Official with EIC Inspection Agency Corporation, 3705 Kennedy Boulevard, Jersey City, NJ 07307.
2. This contract shall become effective on May 19, 2012, for a period of two (2) years, with an option to extend for a further period of one (1) additional year.
3. The fee collected for elevator inspections shall be sixty-four (64%) per cent of the listed fee schedule as promulgated by the State of New Jersey, Uniform Construction Code, N.J.A.C 5:23-4.20. An administrative fee of forty (40 %) percent is to be received by the City of Newark, based on the amount to be paid to EIC Inspection Agency Corporation, 3705 Kennedy Boulevard, Jersey City, NJ 07307, pursuant to the contract.
4. The Department of Engineering through its Construction Code Official is hereby authorized to oversee the work of the on-site Elevator Sub-Code Official and arrange for the deposit of the city's share of the elevator inspection fees into the "Elevator Inspection Trust Fund". The authorization to continue the Elevator Inspection Trust Fund shall conform to all State of New Jersey statutes and regulations presently in force, or to be amended in the future.
5. No certification of funds is required for this contract since the funds to pay the private on-site inspection agency to serve as the on-site Elevator Sub-Code Official will be generated form the fees collected for elevator inspections. No fees need to be paid to the agency if an inspection does not take place, and no fees are generated.
6. This contract is being awarded pursuant to the fair and open procedures of the State of New Jersey Pay-to -Play Law N.J.S.A. 19:44A-20.5 and pursuant to the provisions of the Local Public Contracts Law N.J.S.A. 40A:1 1-5(l)(a)(i) and is in compliance with Executive Order MEO-07-0001, effective March 31, 2007.
7. A fully executed copy of this contract shall be filed in the Office of the city Clerk, as well as, forwarded to the Department of Community Affairs (DCA), State of New Jersey by the Director of the Department of Engineering.
S T A T E M E N T
This resolution authorizes the Mayor and the Director of the Department of Engineering to accept the proposal and execute Contract #05-2012 Third Party Elevator Inspections and Plan Review Services, with EIC Inspection
Agency Corporation, 3705 Kennedy Boulevard, Jersey City, NJ 07307, and to act as on-site Elevator Sub-Code Official to inspect and review plans for elevators in the city, as per the State of New Jersey Uniform Construction Code, and related regulations in force, or to be amended in the future, for a period of two (2) years from May 19, 2012 with an option to extend for a further period of one (1) year. No municipal funds need to be expended for this resolution.
