WHEREAS, Public Service Enterprise Group Foundation (“PSEG”), in furtherance of its corporate commitment to the communities which it serves granted funds to the City of Newark (“the City”) to support “Sustainable Neighborhoods,” which seeks to support programs that help to build safe, healthy and sustainable communities by supporting community centers to help strengthen family units; and

 

                     WHEREAS, through Resolution 7R10-a adopted on April 15, 2015, the City accepted the funds that will fully fund the Renovation Project, known as the Boylan Street Mini Sports Complex in an amount not to exceed $99,300.00 (Ninety Nine Thousand Three Hundred Dollars and Zero Cents) for the renovation work itself, with the remaining $700.00 (Seven Hundred Dollars and Zero Cents) for the purchase of tee-shirts and supplies for a ribbon-cutting event to celebrate completion of the Renovation Project; and

 

WHEREAS, on June  9, 2015, the City of Newark through its City Purchasing Agent advertised to solicit bids for Sports Court Construction, Mini Sports Complex; and

 

WHEREAS, on June 25, 2015, no bids were received in response to this advertisement; and

 

WHEREAS, on July 14, 2015, the City Purchasing Agent re-advertised for Sports Court Construction, Mini Sports Complex; and

 

WHEREAS, on July 30, 2015, the City received one bid but it was found to be unresponsive and no action to award a contract could be proposed and is interpreted as the City having received no bids on this occasion; and

 

WHEREAS,  pursuant to N.J.S.A. 40A:11-5(3)(ii), the City of Newark through its Division of Central Purchasing in collaboration with the Department of Engineering, Business Administrator, Department of Neighborhood and Recreational Services negotiated a contract with NJPS Court Builders, Inc., to provide Sports Court Construction, Mini Sports Complex; and

 

WHEREAS, no material or substantive changes have been made to the specification as previously advertised and NJPS Court Builders, Inc., has provided all documents required by the City; and 

 

WHEREAS, this award recommendation meets the requirements of the fair and open process pursuant to N.J.S.A.19:44A-20.5 et seq.

 

NOW, THEREFORE, BE IT RESOLVED, BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:

 

1.                     The Mayor and/or his designee the Director of Central Purchasing are hereby authorized to enter into contract with NJPS Court Builders, Inc. 95 Robbinsville Allentown Road, Robbinsville, New Jersey 08691 (and in collaboration with the Director of Engineering, Business Administrator and Director of Department of Neighborhood  and Recreational Services) to provide Sports Court Construction, Mini Sports Complex to the City (also known as the Renovation Project - Boylan Street Mini Sports Complex) whose bid was negotiated as authorized by N.J.S.A.40A:11-5(3)(ii) in accordance to previously advertised specifications.  Upon adoption of this resolution by the Municipal Council the term of the contract will be established for a term not to exceed December 31, 2015.

 

2.                     There shall be no amendment or change of this contract without the approval of the Municipal Council.

 

3.                     There shall be no advance payment on this contract in accordance with N.J.S.A. 40A:5-16.

 

4.                     This contract shall not exceed $99,300.00 (Ninety-Nine Thousand Three Hundred Dollars and Zero Cents) with the remaining $700.00 (Seven Hundred Dollars and Zero Cents) for the purchase of tee-shirts and supplies for a ribbon-cutting event to celebrate completion of the Renovation Project.

  Funds for this project are provided by a $100,000.00 (One Hundred Thousand Dollars and Zero Cents) grant from PSEG,

 A copy of the grant budget and amount is attached identifying the grant funds. 

 

5.                     A duly executed copy of the contract shall be forthwith filed in the Office of the City Clerk by the Director of Central Purchasing.

                     

6.                     If required by State law, the City Clerk shall provide the appropriate notice of the award of this contract to the State Comptroller no later than 20 Business days following such award, in accordance with N.J.S.A. 52:15C-10 and the Notice of the Office of the State Comptroller dated May 7, 2008.
