WHEREAS, the New Jersey State Legislature has appropriated funding under the Body Armor Replacement Fund; pursuant to N.J.S.A. 52:17B-4.4 to provide for the purchase of body armor vests for eligible police officers in the State of New Jersey; and
WHEREAS, the City of Newark is committed to ensuring the safety of its police officers in the performance of their duties; and
WHEREAS, on June 21, 2011, on behalf of the City of Newark, the Director of Police submitted an electronic application to the New Jersey Division of Criminal Justice (the NJDCJ) requesting funding (to be set by a pre-determined formula) from the FY2011 State Body Armor Replacement Fund Program Grant, for the purchase of body armor vests with no City funds required; and
WHEREAS, as a result of this application, the City of Newark Police Department has been awarded funding in the amount of $94,228.25 from the NJDCJ for the purchase of body armor vests for the period commencing on November 1, 2011, and terminating on October 31, 2016; and
WHEREAS, the City is not required to execute a grant agreement with the NJDCJ in order to obtain the grant award and no City funds are required.
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:

- The Mayor and/or his designee, the Director of Police are hereby authorized to submit an application to the New Jersey Division of Criminal Justice requesting grant funding from the State Body Armor Replacement Fund Program for the purchase of body armor vests with no City funds required (a copy of the application is attached hereto and made a part hereof).
- The Municipal Council hereby ratifies its authorization of this application from the date of application submission to the date of adoption of this authorizing resolution.

- The grant award in the amount of $94,228.25 from the New Jersey Division of Criminal Justice is hereby accepted (a copy of the award letter is attached hereto and made a part hereof).
- The Mayor and/or his designee, the Director of Police, are hereby authorized to accept the grant funding from the New Jersey Division of Criminal Justice and expend the grant in the amount of $94,228.25 for costs associated with the purchase of body armor for Newark police officers for the period commencing on November 1, 2011, and terminating on October 31, 2016.

- The agreement between the City of Newark and the New Jersey Division of Criminal Justice is hereby ratified from November 1, 2011, to the date of adoption of this authorizing resolution.

- The City is not required to execute a grant agreement with the NJDCJ in order to obtain the grant award.
- No municipal funds are required for receipt or acceptance of this grant award.

- The Director of Police shall file a copy of the grant application and the grant award letter in the Office of City Clerk.
STATEMENT
This resolution ratifies and authorizes the Mayor and or his designee, the Director of Police on actions taken to submit an application for grant funding and to enter into and execute an agreement with the New Jersey Division of Criminal Justice, State Body Armor Replacement Fund Program for the purchase of body armor for Newark police officers in the grant amount of $94,228.25 for the period commencing on November 1, 2011, and terminating on October 31, 2016. No municipal funds or execution of a grant agreement are required.
