WHEREAS, the State of New Jersey Department of Transportation ("NJDOT") State Aid to Counties and Municipalities FY2014 Municipal Aid Program ("NJDOT Municipal Aid Program") provides grant funding for the improvement and construction of local, municipal, and county road and bridge projects; and
 
      WHEREAS, on August 28, 2013, on behalf of the City of Newark, the Director of the Department of Engineering submitted an application to NJDOT requesting grant funding in the amount of $1,721,999.97 from the NJDOT Municipal Aid Program for improvements to various streets (10 locations) within the City of Newark, identified as application MA-2014-Newark City-00248 with no City funds required; and
 
WHEREAS, pursuant to Resolution 7R4-D adopted October 17, 2013, the City of Newark ratified and authorized the actions taken by the Director of the Department of Engineering to submit an application for grant funding from the NJDOT for the NJDOT Municipal Aid Program for improvements to various streets (10 locations) within the City of Newark; and
 
WHEREAS, the City of Newark received notice on June 4, 2014 (copies of the grant award letter and the NJDOT executed Grant Agreement is attached hereto and made a part hereof) that it has been awarded a grant in the amount of $1,354,440.00 from the NJDOT Municipal Aid Program for improvements to various streets (10 locations) within the City of Newark, with no City funds required; and
 
      WHEREAS, the City must execute a Grant Agreement with NJDOT in order to obtain the grant award for $1,354,440.00 with no City funds required.
 
 
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
    1. The Mayor and/or his designee, the Director of the Department of Engineering, are hereby authorized to accept the grant award in the amount of $1,354,440.00 from the New Jersey Department of Transportation (NJDOT) (a copy of the NJDOT grant award letter is attached hereto and made a part hereof).
    1. The Mayor and/or his designee, the Director of the Department of Engineering, are hereby authorized to enter into and execute a Grant Agreement with the New Jersey Department of Transportation to receive and expend the grant award in the amount of $1,354,440.00 from the NJDOT Municipal Aid Program for improvements to various streets (10 locations) within the City of Newark (a copy of the NJDOT executed Grant Agreement is attached hereto and made a part hereof).
    1. The Grant Agreement between the City of Newark and the New Jersey Department of Transportation is hereby ratified from May 21, 2014 to the date of adoption of this authorizing resolution.
    1. The Director of the Department of Engineering shall file a fully-executed copy of the grant application, the grant award letter, the Grant Agreement and the final authorization letter, along with this authorizing resolution in the Office of the City Clerk.
 
 
STATEMENT
 
This resolution hereby amends Resolution 7R4-D adopted October 17, 2013, and ratifies and authorizes the actions taken by the Director of the Department of Engineering to submit an application for grant funding from the New Jersey Department of Transportation (NJDOT), NJDOT Municipal Aid Program, and furthermore, ratifies and authorizes the Mayor and/or his designee, the Director of the Department of Engineering, to enter into and execute a Grant Agreement and accept grant funds in the amount of $1,354,440.00 for improvements to various streets (10 locations) within the City of Newark. No municipal funds are required for receipt or acceptance of this grant award.
