WHEREAS, the Local Redevelopment and Housing Law, N.J.S.A. 40A:12A-1 et seq. (the "LRHL"), authorizes municipalities to designate areas of the municipality as "Areas in Need of Redevelopment" if one or more of the conditions delineated within N.J.S.A. 40A:12A-5 exist within such areas; and
 
      WHEREAS, the LRHL further provides that prior to making a redevelopment area designation, the municipal Governing Body must authorize the municipal Planning Board to conduct a preliminary investigation of the proposed study area and to hold a hearing, on notice to all interested parties, regarding the proposed designation of the study area as an "Area in Need of Redevelopment"; and
 
      WHEREAS, the LRHL also provides that the municipal Governing Body must state in the resolution authorizing the preliminary investigation whether the redevelopment area determination shall authorize the municipality to use all those powers provided by the Legislature for use in a redevelopment area other than the use of eminent domain (i.e. a "Non-Condemnation Redevelopment Area") or whether the redevelopment area determination shall authorize the municipality to use all those powers provided by the Legislature for use in a redevelopment area, including the power of eminent domain (a "Condemnation Redevelopment Area"); and
 
      WHEREAS, the Municipal Council of the City of Newark wishes to authorize the Newark Central Planning Board to conduct a preliminary investigation into whether the following properties qualify as one or more Non-Condemnation Redevelopment Areas under the LRHL:

NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF CITY OF NEWARK, NEW JERSEY, THAT:
 
1.      The Newark Central Planning Board be and is hereby authorized to conduct a preliminary investigation to determine whether the following properties qualify as one or more Non-Condemnation Redevelopment Areas under the Local Redevelopment and Housing Law, N.J.S.A. 40A:12A-1 et seq. ("LRHL"):

The Central Planning Board is directed to conduct this preliminary investigation and to hold a hearing, on notice as required under the LRHL, and to thereafter provide its recommendations to the Municipal Council as to whether the listed properties should be determined to be one or more Non-Condemnation Redevelopment Areas under the LRHL.
 
2.      The Office of the City Clerk shall forward a true copy of this resolution to the City of Newark Central Planning Board and the Planning Board Attorney.
 
3.      This resolution shall take effect immediately in accordance with law.
 
STATEMENT
 
This resolution authorizes the Central Planning Board to conduct a preliminary investigation and, in connection therewith, to hold a public hearing after public notice, to determine whether the following properties should be determined to be one or more Non-Condemnation Redevelopment Areas under the Local Redevelopment and Housing Law, N.J.S.A. 40A:12A-1 et seq.:
