WHEREAS, the City of Newark (the “City”) seeks to partner with emergency shelters that will provide temporary housing accommodations and supportive services to homeless Newark residents; and
WHEREAS, pursuant to State Local Public Contracts Law, N.J.S.A. 40A:11-4.1(b)(2), the competitive contracting process may be used for the operation, management or administration of social service programs; and
WHEREAS, pursuant to the Fair and Open Process of State Pay-to-Play Law, N.J.S.A. 19:44A-20.5, the City publicly advertised a Request for Proposal (RFP) on or about January 13, 2026, for Emergency Housing Program For Individuals and Families with all such proposals due on February 10, 2026; and
WHEREAS, the Proposal received from YMCA of Newark and Vicinity, 600 Broad Street, Newark New Jersey 07102 (hereinafter referred to as “Recipient”), was advantageous to the City of Newark based on experience and all other criteria listed in the RFP; and
WHEREAS, the Director of the Department of Health and Community Wellness (“DHCW”), Office of Homeless Services desires to enter into an Agreement with the Vendor, for the purpose of providing Emergency Housing Program for Newark Residents, Individuals and Families services for the contract period commencing April 1, 2026 through March 31, 2027, with an initial performance period of April, 1, 2026 through May 31, 2026 for Four Hundred Eighty-Four Thousand Nine Hundred Fifty Dollars and Zero Cents ($484,950.00) partially certified, for a total not to exceed amount of Two Million Nine Hundred One Thousand Seven Hundred Fifty Dollars and Zero Cents ($2,901,750.00), the balance of the contract is subject to the availability of funds; and
WHEREAS, this Contract is awarded to the Vendor, in compliance with Local Public Contracts Law, including but not limited to N.J.S.A. 40A:11-4.1(b)(2) and/or N.J.S.A. 40A:11-5, is in compliance with the State Pay-to-Play and the City’s Pay-to-Play Ordinance and Emergency Housing Program for Newark Residents Individuals and Families; and
WHEREAS, the Municipal Council of the City of Newark deems it to be in the best interest of the City to enter into a contract with Vendor for the provision of emergency housing for the Emergency Housing Program for Newark Resident Individuals and Families.
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. The Mayor and/or his designee, and the Director of the Department of Health and Community Wellness, Office of Homeless Services, are hereby authorized to enter into and execute an Agreement with YMCA of Newark and Vicinity, 600 broad Street, Newark, New Jersey 07102, (hereinafter referred to as “Recipient”), for the period commencing April 1, 2026 through March 31, 2027 with an initial performance period of April 1, 2026 through May 31, 2026, Four Hundred Eighty-Four Thousand Nine Hundred Fifty Dollars and Zero Cents ($484,950.00) partially certified, for a total not to exceed amount of Two Million Nine Hundred One Thousand Seven Hundred Fifty Dollars and Zero Cents ($2,901,750.00), to provide Emergency Housing Program services, which are further described in the “Scope of Services” attached hereto and made a part of this Agreement.
2. The terms of this Agreement may only be waived or amended in writing and signed by the parties duly authorized to execute this Agreement, subject to the approval of the Newark Municipal Council by Resolution. The term of this Agreement may be extended for up to two (2) 6-month periods, provided that any such extension is at no additional cost to the City, is authorized by Resolution of the Newark Municipal Council including a finding that the services are being performed in an effective and efficient manner; and is in writing signed by both parties.
3. The Municipal Council ratifies the use of competitive contracting for processing and awarding Housing and Urban Development Entitlement Programs from April 1, 2026 to the date of adoption of this Resolution and authorizes its use in the future.
4. The Agreement between the City of Newark and Recipientis hereby ratified from April 1, 2026 to the date of adoption of this authorizing Resolution.

Pursuant to N.J.A.C. 5:30-5.5, attached hereto is a partial Certification of Funds from the Director of Finance, which states that funds in the amount of Four Hundred Eighty-Four Thousand Nine Hundred Fifty Dollars and Zero Cents ($484,950.00) are available in the 2026 Temporary Budget Under Business Unit: NW011, Department 200, Div/Proj. 2001-Activity A, Account #97550 Budget Ref B2026 . Funding beyond the Temporary Budget is subject to the availability and appropriation of funds. After adoption of the 2026 Budget, a certificate of availability of funds shall be prepared for the remaining balance of the entire contract and same shall be filed together with this Resolution in the Office of the City Clerk.

This Agreement is being awarded pursuant to the fair and open procedures of the State Pay-to-Play Law, N.J.S.A 19:44A-20.5, State Local Public Contracts Law, including, but not limited to N.J.S.A. 40A:11-4.1(b)(2) and/or N.J.S.A. 40A:11-5, and Emergency Housing Program for Newark Residents Individuals and Families.

8. An executed copy of said Agreement, Certification of Funds, along with a
Certified copy of this Resolutionshall be filed with the Office of the City Clerk by the Director of the Department of Health and Community Wellness, Office of Homeless Services.
