WHEREAS, on December 18, 2024, the Newark Municipal Council adopted Resolution 7R9-b, authorizing City's submission of an electronic application for funding from the American Rescue Plan, the acceptance of Grant Funds in the amount of One Million Dollars ($1,000,000.00) from the New Jersey Department of Community Affairs ("DCA"), and the execution of Grant Documents for the purchase of two (2), or more, fire trucks to augment the City of Newark's fleet and to respond to calls throughout the City; and
WHEREAS, the Grant Agreement was executed on or about Decemeber 23, 2024; and
WHEREAS, the Department of Community Affairs has increased the Grant Award from One Million Dollars and Zero Cents ($1,000,000.00) to Two Million Dollars and Zero Cents ($2,000,000.00); and
WHEREAS, the DCA has amended the Grant Agreement with the City of Newark for the Newark Fire Trucks and Equipment Program (a copy of the Amended Agreement is attached hereto and made a part hereof), in order to memorialize the terms of the Grant to include the increase from One Million Dollars and Zero Cents to Two Million Dollars and Zero Cents; and
WHEREAS, the Municipal Council finds it in the interest of the City to execute the Grant Agreement to receive the additional funding.
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. The Grant Amount awarded by the New Jersey Department of Community Affairs ("DCA") authorized by Resolution 7R9-b adopted on December 18, 2024 is hereby amended to increase the amountfrom from One Million Dollars and Zero Cents ($1,000,000.00) to Two Million Dollars and Zero Cents ($2,000,000.00) (Grant Award).
2. Director of the Department of Public Safety, Division of Fire, are authorized to receive and expend the Grant Award for the amended grant amount (a copy of the original award letter and the memo amending the same are attached hereto and made a part hereof).
3. The Mayor and/or his designee, the Business Administrator, are hereby authorized to enter into and execute the amended Grant Agreement, with the DCA, in the amount of Two Million Dollars and Zero Cents ($2,000,000.00).
4. The Newark Municipal Council hereby ratifies its authorization to execute the Award Grant Agreement from June 30, 2025 to the date of adoption of this authorizing Resolution.
5. All other terms and conditions of Resolution 7R9-b adopted on December 18, 2024 and the original Agreement shall remain in full force and effect.
6. The Director of the Department of Public Safety, Division of Fire, shall place the executed Award Agreement along with this Resolution on file in the Office of the City Clerk.
4. This Resolution is ratified back from December 18, 2024 to the date of its adoption.
