AN ORDINANCE TO ADOPT THE “BLOCK 1913, LOT 2 REDEVELOPMENT PLAN” AKA 175-199 FIRST STREET, OF THE CITY OF NEWARK, COUNTY OF ESSEX.

WHEREAS, the Local Redevelopment and Housing Law, N.J.S.A. 40A:12A-1 et seq. (the “Redevelopment Law”), authorizes municipalities to determine whether certain land in the municipality constitutes an area in need of redevelopment; and

 

                     WHEREAS, in accordance with the Redevelopment Law and by Resolution 7R3-F(s), adopted on June 3, 2015, the Municipal Council (the “City Council”) of the City of Newark (the “City”) directed the Central Planning Board to conduct a preliminary investigation of certain property identified as Block 1913, Lot 2, more commonly known as 175-199 First Street, in the Central Ward of the City of Newark, in the County of Essex (the “Property”), to determine if the Property meets the criteria of an area in need of redevelopment under the Redevelopment Law; and

 

                     WHEREAS, the Central Planning Board adopted a Resolution on August 24, 2015 that determined that the Property does meet the criteria as an area in need of redevelopment under the Redevelopment Law; and

 

                      WHEREAS, pursuant to N.J.S.A. 40A:12A-4(a)(3) and N.J.S.A. 40A:12A-7, the City Council is empowered to adopt a redevelopment plan pursuant to which redevelopment projects are to be undertaken or carried out within an “area in need of redevelopment,” and

 

                     WHEREAS, pursuant to that authority the City Council caused a redevelopment plan for the Property to be prepared, entitled the “Block 1913, Lot 2 Redevelopment Plan” (the “Redevelopment Plan”), attached hereto as Exhibit A; and

 

                     WHEREAS, simultaneously with this Ordinance, the Deputy Mayor/Director of the Department of Economic and Housing Development has sent a resolution to the Municipal Council that declares Block 1913, Lot 2 as an area in need of redevelopment (the “Redevelopment Area”) and refers the Redevelopment Plan to the Central Planning Board, to determine is such plan is consistent with the City’s Master Plan and for recommendations pursuant to N.J.S.A. 40A:12A-7. 

 

                     WHEREAS, the City Council, has referred the Redevelopment Plan to the Central Planning Board for its review and recommendation pursuant to N.J.S.A. 40A:12A-7(e); and

 

                     WHEREAS, the Central Planning Board, at a duly noticed and constituted public meeting, reviewed the Redevelopment Plan; and

 

                     WHEREAS, following such review the Planning Board has rendered its report and recommendations to the City Council and recommended the adoption of the Redevelopment Plan pursuant to N.J.S.A. 40A:12A-7(e); and

 

                     WHEREAS, the City Council hereby finds it appropriate for the Redevelopment Plan to be adopted for the Property, being, among other things, substantially consistent with the Master Plan for the City; and

 

                     WHEREAS, the City Council now desires to adopt the Redevelopment Plan and to direct that the applicable provisions of the City’s Zoning Ordinance and Map be amended and superseded to reflect the provisions of the Redevelopment Plan, as and to the extent set forth therein.

 

NOW THEREFORE, BE IT HEREBY ordained by the municipal council of the city of Newark, new Jersey,  THAT:

 

                     Section 1.  The aforementioned recitals are incorporated herein as though fully set forth at length.

 

                     Section 2.  The “Block 1913, Lot 2 Redevelopment Plan”, as filed in the Office of the City Clerk and attached hereto as Exhibit A, is hereby approved and adopted.

 

                     Section 3.  The sections of the City’s Zoning Ordinance and Map are hereby amended to incorporate and reflect the Redevelopment Plan, and, to the extent provided in the Redevelopment Plan, are superseded thereby.

 

                     Section 4.  If any part of this Ordinance shall be deemed invalid, such parts shall be severed and the invalidity thereof shall not affect the remaining parts of this Ordinance.

 

                     Section 5.  A copy of this Ordinance and the Redevelopment Plan shall be filed with the City Clerk by the Deputy Mayor/Director of the Department of Economic and Housing Development.

 

                     Section 6.  This Ordinance shall take effect upon final passage and publication in accordance with the Law.

 

 

STATEMENT

 

This ordinance adopts the “Block 1913, Lot 2 Redevelopment Plan” AKA 175-199 First Street.
