WHEREAS, on April 13, 2026, the City of Newark, Department of Engineering (the “City”), pursuant to N.J.S.A. 40A:11-1, et seq., publicly advertised to solicit bids for the Broadway Park Improvement, Contract #2026-03; and
WHEREAS, the City distributed seven (7) bid proposal packages to prospective vendors following the date of advertisement; and
WHEREAS, on May 7, 2026, in accordance with the public advertisement, two (2) bids were received, publicly opened, and read aloud for Contract #2026-03 for the improvement of Broadway Park, located at 683 Broadway, Newark, New Jersey (“Project”); and
WHEREAS, Flanagan’s Contracting Group, Inc., 90 Old Camplain Road, Hillsborough, New Jersey 08844 (“Contractor”), the lowest bidder on the Project, submitted a bid in the total amount of Five Million One Hundred Fifty One ThousandThree Hundred Fifty Dollars and Ninety Cents ($5,151,350.90), per the project specifications and N.J.S.A. 40A:11-1, et seq.; and
WHEREAS, on June 11, 2026, the Acting Director of the Department of Engineering recommended that an award be made to Contractor as the lowest responsive and responsible bidder; and
WHEREAS, Pursuant to N.J.S.A. 40A: 11-24, the Contractor
WHEREAS, Pursuant to N.J.S.A. 19: 44A-20.5 solicitations through public bidding in accordance with N.J.S.A. 40A: 11-1 et. Seq. meets the requirements of the fair and open process.
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. The Mayor of the City of Newark and/or his designee, the Acting Director of the Department of Engineering (“Director”), are hereby authorized to award Contract #2026-03 to Flanagan’s Contracting Group, Inc., 90 Old Camplain Road, Hillsborough New Jersey 08844 (“Contractor”) for a total contract amount not to exceed Five Million Two Hundred Forty Nine Thousand Forty Two -Six Dollars and Ninety Cents ($5,249,042.90) for the Broadway Park Improvement Project, which is located at 683 Broadway, Newark, New Jersey. The contract term shall be for a period of three hundred sixty-five (365) consecutive calendar days from the date of the issuance of a written Notice to Proceed.
2. No changes to this contract shall be allowed or authorized without prior Municipal Council approval.
3. A fully executed copy of the contract shall be filed in the Office of the City Clerk by the Acting Director of Engineering and/or her designee.
4. The contract is to be completed within 365 consecutive calendar days from the issuance of a formal Notice to Proceed.
5. The public bidding process under the New Jersey Local Public Contracts Law, N.J.S.A. 40A:11-1 et seq., complies with the Fair and Open Process of the State of New Jersey Local Unit Pay-to-Play Law, N.J.S.A. 19:44A-20.5 et seq.
6. No advance payments shall be made against the contract in accordance with N.J.S.A. 40A:5-16.
7. Attached is a Partial Certification of Funds issued by the Chief Financial Officer which states that funds in the amount of $300,000 are available for the purposes stated herein in the Temporary Budget - NW026, Account 32720, Budget 2026
8. A copy of the said certification of Funds shall be filed in the Office of the City Clerk with this Resolution.
9. If required by State Law, the City Clerk shall provide the appropriate Notice of Award to the State Comptroller within twenty (20) business days of the award, in accordance with N.J.S.A. 52:15C-10.

[This Resolution authorizes the Mayor and/or the Acting Director of the Department of Engineering to award Contract #2026-03 to Flanagan’s Contracting Group, Inc., 90 Old Camplain Road, Hillsborough New Jersey 08844 for the Broadway Park Improvement Project, which is located at 683 Broadway, Newark, New Jersey., in the amount not to exceed $5,151.350.90. The contract is to be completed within 365 consecutive calendar days from the issuance of a Notice to Proceed issued by the Acting Director of the Department of Engineering and/or her designee.
