This Amending Resolution amends Resolution 7R5-a 02/19/2025 to reflect the total amount of grant funding ($5,533,844.00) received from the FY2025 Ending the HIV Epidemic (EHE) in the United States Program.

WHEREAS, on October 22, 2024, on behalf of the City of Newark (hereinafter, "City"), the Director of the Department of Health and Community Wellness (hereinafter, "DHCW") submitted an application to the United States Department of Health and Human Services, (hereinafter, "HRSA"), 5600 Fishers Lane, Rockville, Maryland 20857, requesting funding in the amount of twenty-six million, thirty-five thousand, six hundred thirty-four dollars ($26,035,634.00) for the continued provision Ending the HIV Epidemic and related services for Persons with HIV residing in the City of Newark and Essex County; and

WHEREAS, as a result of the City's application, HRSA has notified the City of a several awards for the continued provision of Ending the HIV Epidemic and related services for Persons with HIV residing in the City of Newark and Essex County for the budget period of March 1, 2025 through February 28, 2030, in an amount not to exceed Five Million Five Hundred Thirty-Three Thousand Eight Hundred Forty-Four Dollars and Zero Cents ($5,533,844.00); and
WHEREAS, on February 19, 2025, the Municipal Council adopted Resolution 7R5-a, accepting a partial Grant Award in the amount of One Million Seventy-Six Thousand Nine Hundred Seventeen Dollars and Zero Cents ($1,076,917.00); and

WHEREAS, on July 8, 2025, July 24, 2025 and November 25, 2025, HRSA made additional funds available in the amount of Five Eight Hundred Thousand Five Hundred and Seventy-Eight Dollars and Zero Cents ($508,578.00), Eight Hundred Eighty-Four Thousand Eight Hundred and Four Dollars and Zero Cents ($884,804.00), and Three Million Sixty-Three Thousand Five Hundred Forty-Five Dollars and Zero Cents ($3,063,545.00) respectively; and

WHEREAS, the Department of Health and Community Wellness desires to amend Resolution 7R5-a adopted on February 19, 2025 to reflect the additional Grant Funds received for a total Award Amount of Five Million Five Hundred Thirty-Three Thousand Eight Hundred Forty-Four Dollars and Zero Cents ($5,533,844.00); and

WHEREAS, the City recognizes that HRSA may extend the Grant Period and may provide additional funding when it becomes available; and

WHEREAS, HRSA may amend the Grant to reflect any time extension and/or award of additional funding if made available.

NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:

1. Resolution 7R1-a adopted on February 19, 2025, which accepted Grant Funds in the amount of One Million Seventy-Six Thousand Nine Hundred Seventeen Dollars and Zero Cents ($1,076,917.00) is hereby amended to authorize The Mayor of the City of Newark and/or his designee, the Director of the Department of Health and Community Wellness, to accept and expend additional Grant Funds awarded by United States Department of Health and Human Services, (HRSA), 5600 Fishers Lane, Rockville, Maryland 20857 awarded on July 8, 2025, July 24, 2025 and November 25, 2025, in the amounts of Five Eight Hundred Thousand Five Hundred and Seventy-Eight Dollars and Zero Cents ($508,578.00), Eight Hundred Eighty-Four Thousand Eight Hundred and Four Dollars and Zero Cents ($884,804.00), and Three Million Sixty-Three Thousand Five Hundred Forty-Five Dollars and Zero Cents ($3,063,545.00) respectively for the continued provision of Ending the HIV Epidemic and related services for people with residing in Essex County, for the budget period commencing on March 1, 2025 and terminating on February 28, 2030. (A copy of the Notice of Awards, Temporary Appropriations and the Budget Insertion Resolutions are attached hereto and made a part hereof).





2. Resolution 7R5-a adopted on February 19, 2025, is further amended to authorize the Mayor of the City of Newark and/or his designee, the Director of the Department of Health and Community Wellness to accept any additional Grant Awards and enter into and execute Grant Documents with the United States Department of Health and Human Services, Health Resources and Services Administration necessary to receive and expend Grant Funds pursuant to the terms of the Grant Documents.

3. The authorization granted hereunder is ratified back from February 19, 2025 to the date of adoption of this amending Resolution.


4. All other terms of Resolution 7R5-a adopted on February 19, 2025 shall remain the same.


5. The Director of the Department of Health and Community Wellness shall file a fully executed copy of the Grant Application and the Grant Award letter in the Office of the City Clerk.

STATEMENT

This Resolution ratifies, authorizes, and amends the actions taken by the Director of the Department of Health and Community Wellness via Resolution 7R5-a February 19, 2025, which accepted the FY 2025 partial Grant Funds in the amount of One Million Seventy-Six Thousand Nine Hundred Seventeen Dollars and Zero Cents ($1,076,917.00), to further accept additional Grant Funds awarded by HRSA on July 8, 2025, July 24, 2025 and November 25, 2025 in in the amounts of Five Eight Hundred Thousand Five Hundred and Seventy-Eight Dollars and Zero Cents ($508,578.00), Eight Hundred Eighty-Four Thousand Eight Hundred and Four Dollars and Zero Cents ($884,804.00), and Three Million Sixty-Three Thousand Five Hundred Forty-Five Dollars and Zero Cents ($3,063,545.00) respectively. It further authorizes the acceptance and expenditure of future Grant Funding and execution of grant documents with the United States Department of Health and Human Services, Health Resources and Services Administration for the continued provision Ending the HIV Epidemic and related services for Persons with HIV residing in the City of Newark and Essex County.
